Research On Legal Protection Of Reproductive Rights Of Single Women

The rapid economic growth,the prosperity of science and technology,and the popularization of education have injected a steady stream of vigorous forward momentum into today's society.The face of women in our country has also been brand-new,and there are many outstanding female practitioners in various positions.Among them,more and more women are taking a more cautious attitude towards marriage,and late childbearing or even non-marriage is becoming more common.Article 32,paragraph 2,of the 2002 "Regulations on Population and Family Planning of Jilin Province" stipulates that single women can use human assisted reproductive technology,which has been questioned by most scholars;the first domestic "egg freezing case" in 2019 is still under further trial,There is no conclusion;recently,Sun Wei,deputy to the National People's Congress,put forward another proposal on“prohibiting medical institutions from freezing eggs for single women”,which caused heated public debate.The emergence of the problem cannot be ignored.So when single women want to realize their reproductive rights,can they be allowed to exercise their reproductive rights? If the answer is yes,how the law should protect the exercise of reproductive rights of single women is worth pondering.This article starts from the basic theory of reproductive rights,defines the concept,attributes basic content of reproductive rights,and draws the conclusion that single women are the subjects of reproductive rights,and the reproductive rights is a basic human right;secondly,by demonstrating the legitimacy and the feasibility of the realization of the rights provide theoretical and practical support for the study of the legal issues of single women's reproductive rights.Thirdly,the analysis of the value and current situation of the protection of single women's reproductive rights in China reveals that single women's reproductive rights in China has a low level of legislation,lack of legal ways for them to realize reproductive rights,and the legal provisions is unclear;finally,corresponding legal countermeasures are put forward based on the above problems.The first is to establish a legal protection system for single women's reproductive rights from the three levels of the Constitution,ordinary laws,local regulations and other normative legal documents;the second is to provide single women with access to legal reproductive channels and perfect supporting systems.Reproductive rights provide institutional guarantees;the third is to restrict single women's reproductive age,reproductive qualifications,and qualifications of medical institutions,and specify that single women violate the legal responsibility to regulate the exercise of single women's reproductive rights.This article aims to think deeply about the hot issues of the times,protecting their reproductive rights and interests,while improving my country's human rights protection system by regulating the reproductive behavior of single women.
