| With the vigorous promotion of equality between men and women in society,the status of women in China has been unprecedentedly improved.Nowadays women are more economically independent and more confident.At the same time,their attitude towards fertility is different from the past.More and more women,although single,still hope to have the qualifications to be mothers.As some demographic research experts pointed that population development requires new concepts.Contemporary young people’s concepts and behaviors of marriage and childbirth are different from traditional ones.We should face up to the new generation of concepts of marriage and childbirth.Diversity is the trend of the future development of the family.However,there are still many imperfections in the legal system of our country regarding the reproductive right of single women.At present,there is no unified conclusion about the attribute of reproductive rights.There are mainly two theories,namely "the theory of identity rights" and "the theory of personality rights".It is more inclined to the latter.According to the connotation of reproductive rights,it summarizes the specific content of single women’s reproductive rights,which include reproductive self-determination and maternity protection.Then single women have a certain legitimacy for given birth legally,logically,and realistically.In the meantime,the major improvements in science and technology,the progress of social concepts,and the experience of foreign legislation for reference have provided realistic possibilities for the realization of single women’s reproductive rights.Furthermore,it gives an comprehensive analysis about the dilemmas of single women’s reproductive rights,mainly in laws and regulations,policies and ethics.Finally,in order to better guarantee the realization of single women’s reproductive rights,it believes that our country should follow the principle of respect and autonomy and grant single women the freedom to reproduce,but this freedom must be limited.In the legislation of China,different department laws should be unified to form a complete legal protection system.As for the specific legislative protection content,it proposes to identify reproductive methods,restrictions and remedies and set up special legislation,maternity benefits and maternity insurance.There are 0 pictures,0 tables and 52 references in the thesis. |
