Research On The Judicial Cooperation Mechanism Between China And Laos On Drug Crimes

China and Laos are geographically close to each other,and the drug problem has been plaguing both countries.The treatment of drug problem is a systematic project,including politics,economy,grammar and judicature.This paper starts with the judicial cooperation mechanism of drug-related crimes,and makes a concrete analysis of the problems existing in the drug-related cooperation mechanism.Expert for the presentation and competion,this article is divided into four parts:The first part is the analysis of the current situation of mutual legal assistance in drug crimes between China and Laos.At present,China and Laos have formed a cooperative mechanism of mutual legal assistance through memorandum of understanding on drug control cooperation,drug control action plan and Mekong regional cooperation mechanism,showing a new stage of drug control judicial cooperation and a new pattern of normalization of Mekong joint law enforcement.The second part is the judicial mutual aid system of drug crimes between China and Laos.This part introduces the domestic criminal mutual legal assistance system of Laos and China,including the provisions of the Extradition Law of Laos and the specific content of China's criminal mutual legal assistance system.The third part is the analysis of the problems and causes of the mutual legal assistance mechanism between China and Laos.At present,there are some problems in China and Laos,such as the lack of the same norms and available conventions,the restriction of the principle of punishable by both sides and the complication of procedural provisions.The specific reasons are related to China's domestic judicial system and Laos' national cultural habits.The fourth part is the concrete suggestions to improve the mutual legal assistance mechanism between China and Laos.At the legislative level,it is necessary to establish supplementary agreements,introduce the transfer of criminal procedures,simplify procedural provisions and establish the principle of mutual recognition;at the judicial level,it is necessary to establish and strengthen the communication and cooperation between the practical departments and academic institutions.
