| The implementation of the reform of "separation of certificates and licenses" is an important measure to improve China’s business environment and an important system to promote the legalization of the business environment.The system of "separation of certificates and licenses" is a reform that touches on the legal system of market supervision.It can play a certain role in the construction of the new credit supervision system,but it means that the static supervision of the market by the government is transformed into a dynamic one,and the responsibility of government supervision and market self-discipline are still not perfect.At present,China’s information credit and supervision legal system is still in the initial stage of construction,compared with the Developed countries in Europe and the United States,there is still a certain gap.This paper is divided into four parts.One is to discuss the impact of the "separation of certificates and licenses" system reform on the legalization of the business environment based on the achievements of the reform practice.The second is to analyze the relevant legal theories involved in the system of "separation of certificates and licenses";Third,on the basis of the reform experience and theoretical results,summarize the current legal supervision problems after "separation of certificates and licenses";Finally,it puts forward some legal suggestions for the corresponding problems to guarantee the construction of the new credit supervision system.There are two innovations in this paper.First,the topic is based on the achievements and experience of reform and practice,which is of great value in practice;second,this paper discusses the "separation of certificates and licenses" system from the perspective of overall and development,and explores the legal system of comprehensive credit supervision.In this paper,we use inductive analysis,and case analysis,the method of concrete,discusses in detail the "licenses" involved in the legal system and legal problems,and from the Angle of comparative law,draw lessons from foreign mature experience in legal system of credit information.Under the general background and national conditions of the legalization of the business environment,discuss how the "separation of certificates and licenses" system can improve legal supervision during and after the event,and discuss the responsibilities and relationship between the government and the market in the joint supervision model. |
