Research On The Legal Issues Of Single Women’s Reproductive Rights

Present,due to the dramatic changes in social environment and childbearing intentions,single women’s childbearing has become a social phenomenon that can not be ignored.So far,western countries have made corresponding provisions on single women’s fertility through legislation.Compared with the relatively perfect legislation of western countries,the legislation on childbearing in China has a strong sense of obligation standard,and couples are the smallest childbearing subjects,which makes single women face many difficulties in childbearing.Although the former Ministry of Health had issued a departmental regulation on the management of assisted reproductive technology to deal with the problem of single women’s fertility,the regulation has been criticized for its low legal rank,lagging behind the rapid development of social thought,and being suspected of violating the principle of gender equality.We can’t turn a blind eye to the child-bearing demands of single women to avoid problems,nor can we simply and rudely ban them.How to exercise the reproductive rights of single women in an orderly manner and how to be compatible with the existing legal system in China is a question worthy of careful consideration.For this reason,we should not only base ourselves on the actual situation of our country,but also flexibly learn from the mature legislative experience of foreign countries on the issue of single women’s childbearing,so as to protect the childbearing rights of single women.Firstly,this paper clarifies and defines the basic concepts of reproductive right and single women’s reproductive right,and further explains the nature and content of reproductive right.Secondly,this paper discusses the necessity and feasibility of single women’s reproductive rights.Protecting single women’s reproductive rights is not only necessary to deal with the population ageing,but also to comply with the inevitable requirements of social development.Again,this article combs the legislation and judicial status of our country’s single women’s reproductive rights,it also pointed out that the current obstacles to the realization of single women’s reproductive rights are the lack of a clear definition of single women’s reproductive rights,the difficulty for single women to implement Assisted reproductive technology,and the imperfection of supporting systems.Then,this article reviews the overseas advanced legislative experiences on the limitation of the subject of childbearing,the management of Assisted reproductive technology,the social welfare guarantee of single childbearing,etc.,and has analyzed the Enlightenment to our country legislation.Finally,proposed our country single female fertility right realization consummation measure.
