Research On The Legal Security System Of Maintaining And Increasing The Value Of Basic Endowment Insurance Funds In My Country

As the balance of China's endowment insurance fund has been decreasing year by year and its value preservation and appreciation has not been effective,the State Council issued Measure for the Investment Administration of basic Endowment Insurance funds,which can give guidance on investments and relief financial and balance pressures.But due to the lack of other legal provisions matched,The Measures for Investment Management is short of operability,Although the demand and clamour of value preservation and appreciation have been high in real life,bur never department dare to invest without authorization in the absence of specific provisions of relevant laws,which obstructed pension insurance fund to maintain and increase its value and failed to promoted the solution of the pension problem.The establishment of the central adjustment fund system for pension funds has made clear the reality of maintaining and increasing the value of pension funds.The State Council has issued a circular on a comprehensive plan to lower social insurance rates to further reduce the burden of experience cost of small and medium-sized enterprises,implementing the requirements of the 13 th Five-Year Plan,promoting the development of the enterprise,improving the business environment further.Management cost are reduced effectively through decreasing the payment rate of endowment insurance by enterprise pay,which improve the economic efficiency of enterprises.But it should also be noted that this notice will greatly reduce the size of the pension fund collection.The rapid development of economy also requires the pension treatment level to maintain overall stability and improve year by year,the contradiction between the reduction of the supply and the increase further aggravates the burden of pension insurance,and the urgency of maintaining and increasing the value has risen to a higher level.In this paper,the author uses the method of comparative analysis,through the analysis of other countries and institutions in pension preservation and appreciation of the measures,combined with the current status of pension appreciation in China,put forward to protect the pension fund to achieve preservation and appreciation of the legal measures.
