As the only province in China with the distribution of Asian elephant,Yunnan As the only province in China with the distribution of Asian elephant,Yunnan has made a lot of positive exploration in biodiversity protection over the years,and has achieved remarkable results.For example,the legal and regulatory system is becoming increasingly perfect,illegal trade is effectively curbed,monitoring,early warning,and emergency response measures are continuously improved,and post compensation mechanisms are becoming more reasonable.This paper takes the key wildlife habitats as the main research object,and takes the "Broken Nose Family" northward movement event as an example to sort out the legislative evolution and protection status of key wildlife habitats,analyze the wildlife habitats,especially the legal issues of the protection of key wildlife habitats of the wild Asian elephant,and explore the benign regulatory interaction of "government enterprise third-party subject",And based on the effective practical experience of some provinces and foreign countries in China,provide legal countermeasures for the protection of key wildlife habitats in China.This research paper is divided into five parts: The first part is the introduction.Based on the current research status at home and abroad,the author fully summarizes relevant national policies and foreign practical experience,and elaborates on the research background,purpose,significance,and methods of protecting key habitats for wildlife.The second part is an overview of the legal system,elaborating on the connotation of the concept of key habitats,the current legislative status and practical status,and studying and analyzing the directions that need to be improved in the current law.The third part focuses on the analysis of the legal issues of the key habitat protection of the "broken nose family" and the resulting adverse consequences.It mainly analyzes the problems of the imperfect regulatory relationship between the government and enterprises,the imperfect mechanism of the third-party subject to supervise the government,the imperfect mechanism of the third-party subject to supervise the enterprises,and the consequences of the legal issues The poor interaction of third-party regulatory bodies is an important reason for restricting the effective protection of key wildlife habitats.The fourth part,through careful analysis of the wild giant pandas in Hongya County,Meishan,Sichuan Province,the wild animals in Hainan Tropical Rainforest National Park,and the wildlife protection practices in the United States,Canada,Russia,and Australia,studies that strengthening the participation of social organizations,strengthening top-level design,and strengthening publicity and education play an important role in promoting wildlife protection.The fifth part puts forward legal suggestions to improve the protection of key habitat of the "Broken Nose Family",and promotes a more systematic and complete protection mechanism of key habitat of the "Broken Nose Family" by improving the regulatory relationship between the government and enterprises,improving the government mechanism of third-party subject supervision and improving the enterprise mechanism of third-party subject supervision.The author believes that in the context of ecological civilization construction,all sectors of society need to actively explore a new model of environmental governance from the overall perspective.Practice has proved that strengthening the positive interaction of multiple social entities can greatly reduce the negative environmental Externality brought by human development.Wildlife,as an indispensable part of ecological civilization construction,exploring the legal ways of multiple social entities to participate in the protection of key habitats is an inevitable trend of development.
