Research On Government Supervision Under The Third Party Governance Mode Of Environmental Pollution

The concept of "third-party governance of environmental pollution" was first formally proposed in the "Decision of the Central Committee of the Communist Party of China on Several Major Issues Concerning Comprehensively Deepening Reform" of the Third Plenary Session of the 18 th CPC Central Committee.Compared to the traditional "who pollutes,who governs" model,this pollution control model introduces market mechanisms into environmental pollution control,and delegates environmental pollution control to specialized environmental service enterprises for governance.This can reduce pollution control costs and improve pollution control efficiency and quality.Although third-party governance of environmental pollution has many advantages,the environment has a public attribute,and pollution control cannot be regulated by market mechanisms alone,This requires the government to strengthen supervision under this pollution control model.However,this is not the case in practice.The imperfect government regulatory system and the imperfect regulatory procedures have caused some obstacles to the development of third-party governance of environmental pollution.Therefore,how to improve the third-party governance of environmental pollution by government regulation is a problem that needs to be solved urgently to make it truly effective.This article is introduced from the Taizhou Environmental Public Interest Litigation Case to highlight the practical orientation of this article by pointing out the practical problems of inadequate government supervision in the third-party governance model of environmental pollution.At the theoretical level,first of all,it elaborates on the two core concepts of "third-party governance of environmental pollution" and "government regulation",analyzes the theoretical basis of government regulation under the third-party governance model of environmental pollution,examines the current situation of government regulation under the third-party governance model of environmental pollution from both the government regulatory system and regulatory procedures,and conducts in-depth thinking to explore the practical difficulties of government regulation,Then,in view of the existing difficulties,it examines the practice of foreign government environmental supervision,and on this basis,it proposes a series of improvement suggestions,such as strengthening the construction of government regulatory organization systems,strict third-party access audits,strengthening the review and effectiveness evaluation of third-party governance contracts,and optimizing the accountability mechanism of government environmental supervision,to ensure that the role of government regulation is fully played in third-party pollution control,and promote the vigorous development of third-party governance models for environmental pollution,Accelerate the pace of ecological civilization construction in China.
