| Although right to privacy remains a highly controversial issue in modern times,it possesses basis in the history of philosophy, for example, the importance of respecting private sphere can be discovered in Aristotle’s distinction between public and private spheres.Contemporary studies on privacy mainly discuss that privacy shall be protected as an individual right. On this basis, there have been studies on reducing privacy to various rights, such as right to privacy is based on personality right,or right to privacy stems from property right.By establishing privacy protection as a basic right of individuals, the ethical basis of privacy can be guaranteed in legislation, and a series of regulations and measures to protect privacy can be conducted. In addition to the above discussion, however,we shall also note that sense of privacy is a natural emotional response.Privacy infringement will induce anxiety, anger and other negative emotions, which will destroy people’s sense of security and happiness in social life, and ultimately ruin the harmony of social relations, affecting people’s life and work quality. From this perspective, the study on the moral feeling basis of privacy protection is conducive to understanding the significance of privacy protection to personal emotional life, and further promoting the overall happiness of the society. This research offers philosophical value,as well as contributes to the construction of modern civilized society. In general, this paper will discuss the moral feeling basis of privacy protection from the following aspects.First of all,the sense of privacy derives from several basic moral feeling experiences, namely, people’s sympathy and sense of justice. The sense of privacy is closely related to people ’ s important basic existence needs, and constitutes a necessary component of people ’ s healthy life. Therefore, privacy protection requires people’s emotional motivation of mutual understanding, and thus, privacy is closely linked to people’s sympathy.Due to the apparent discrepancy in nature between public and private spheres, respect for people’s private living space has become the essential foundation for people to conduct common social cooperation,so the sense of privacy is also bound up with the sense of social justice. In the second chapter, this paper will deal with the relationship between the sense of privacy and several important basic moral feelings,so as to confirm the source and moral basis of various feelings aroused by the sense of privacy.Secondly, since privacy protection involves not only guarantee for human rights, but also an emotional basis in motivation, privacy protection has real binding forces on people’s behavior. In terms of moral philosophy,a code of conduct originating from moral motivation is more likely to be practiced compared with that motivated only by certain external obligation. As privacy protection possesses real moral feeling basis, the implementation of privacy protection will satisfy the demands of every citizen in the society and improve people’s happiness. In this chapter,we will focus on the emotional binding forces of privacy protection, including privacy and passion, privacy and sense of responsibility, privacy and careful thinking, and privacy and self-control.Although privacy protection is essential to our private and social lives,it remains not of the only importance, nor the only moral value that arouses strong moral feelings, but simply a part of our ethical lives. Therefore, this involves the relationship between privacy and other moral values.Next,we will discuss how the moral feeling of privacy can provide solutions to these problems when privacy conflicts with other social values. Finally,a case study will be conducted to prove the viewpoint of the paper. |
