Research On The Construction And Management Of The New Prison During The Republic Of China (1912-1937)

In the early 20 th century,the Qing government carried out legal reform and judicial reform,and prison administration improvement was one of the important links.Under this background,the new prison were established successively in various provinces,but with the fall of the Qing Court,the reform of prison administration was forced to stop.The prison improvement after the establishment of the Republic of China is a continuation of the prison improvement in the late Qing Dynasty,and its construction and management of the new prison are further advanced than that in the late Qing Dynasty,and the improvement effect is more obvious.Jiangsu First Prison is a miniature of the new prison.The prison,formerly known as Jiangning Criminal Training Institute established in the late Qing Dynasty,was changed to Jiangnan Model Prison in 1909,and was a model new prison in the period of prison administration reform in the late Qing Dynasty.After the outbreak of the Revolution of 1911,the prison was ravaged by war and all the buildings and facilities were destroyed.During the Republic of China,it was rebuilt and developed greatly.As a provincial model prison in the period of Beijing Government and a central model prison in the period of Nanjing National Government,the system construction and practice of Jiangsu First Prison have important theoretical and practical significance.The paper discusses the cause of the corrections is improved in the late Qing Dynasty,analyzed the content of the corrections is improved in the late Qing Dynasty and its effect on the development of the Republic of China new prison,comb from the late Qing Dynasty to the Republic of China for the construction of the new prison,then focused on Jiangsu First Prison,in turn,pay attention to the system presentation and specific practice of the new prison in the Republic of China in terms of construction,management and prisoner reform.The paper analyzes the gap and causes between practice and system,explores the changes of judicial system and ideas behind it,and finally summarizes the references and shortcomings of new prisons in the Republic of China,in order to provide references for the development of modern prisons.
