Research On The Protection Of Law Enforcement Rights And Interests Of Police In Compulsory Detoxification

The judicial administrative compulsory isolation treatment center is an important part of China’s political and legal organs.According to the anti drug law of the people’s Republic of China and the regulations on drug treatment,it exercises the right of compulsory isolation treatment for drug addicts.It is a place for drug addicts to quit drug addiction,transform themselves,and finally return to social life smoothly.As the main body of the law enforcement work of drug treatment,the police in drug treatment industry shoulder the responsibility of managing drug addicts according to law.After the abolition of reeducation through labor system in 2013,the work of China’s compulsory isolation drug treatment center has been steadily promoted,and the relevant laws and regulations have been established from scratch,especially the right protection system for drug addicts has been gradually improved.As the main body of law enforcement,the law enforcement rights and interests of the drug addicts are not well protected,and the law enforcement work environment of the police is not optimistic,which is manifested in the lack of grass-roots police force,long working hours and other practical problems.Some drug treatment centers even have excessive claims of the drug addicts,but the police who undertake the front-line law enforcement work are suffering from multiple pressures,and the law enforcement rights and interests of the police are not well protected Guarantee,is bound to affect the efficiency of law enforcement at the grassroots level.Therefore,it is urgent to study the protection system of law enforcement rights and interests of the police in compulsory detoxification.This paper mainly discusses from the following five aspects:The first part is the introduction.This part mainly expounds the research background,the theoretical and practical significance of the research,the research status and research methods at home and abroad.The second part is the general analysis of the law enforcement rights and interests of the police in compulsory detoxification.This part of the compulsory isolation of drug treatment,drug treatment police,drug treatment police law enforcement rights and interests to do a more detailed definition.On this basis,this paper analyzes the work objectives of the drug rehabilitation police,and analyzes the legitimacy of the protection of law enforcement rights and interests of the drug rehabilitation police from the theoretical and practical aspects.The third part is the analysis of the current situation of the violation of the law enforcement rights and interests of the police in compulsory detoxification.This paper makes a detailed analysis of the current situation of the violation of the law enforcement rights and interests of the drug rehabilitation police from two aspects:one is the violation of the relevant rights and interests based on citizenship in law enforcement;the other is the violation of the relevant rights and interests based on job identity in law enforcement.The fourth part is the analysis of the reasons for the violation of the law enforcement rights and interests of the police in compulsory detoxification.The main reasons are as follows:first,the laws and regulations are not perfect;second,the management of drug treatment organs is lack;third,the quality of drug treatment police is insufficient;fourth,the pressure of public opinion.The fifth part is the suggestion to improve the protection mechanism of law enforcement rights and interests of police in compulsory detoxification.This paper puts forward four suggestions:improving the relevant laws and regulations,improving the internal management of drug treatment organs,improving the law enforcement quality of drug treatment police,and strengthening the guidance of public opinion.
