Study On The Legal Issues Of Maritime Search And Rescue Cooperation In The South China Sea

The South China Sea,located at the crossroads between the Indian Ocean and the Pacific Ocean,is the world’s busiest maritime area.Most of the South China Sea is located in the tropical monsoon belt,with frequent typhoons,complex and changeable maritime climate and high frequency of maritime emergencies.Maritime transportation safety has always been a concern.The practical needs of maritime search and rescue in the South China Sea and the natural advantages of regional search and rescue cooperation mechanism determine the necessity of establishing such a mechanism,which is also a choice in line with the common interests of all countries and peoples in the South China Sea.As China’s maritime search and rescue in the south China sea region emphasis,in recent years,efforts and driven in China,south China sea rescue cooperation has made certain achievements,but the occasional emergency incidents at sea rescue work results show that the south China sea maritime search and rescue forces weak,lack of overall normalized problem is still a problem in maritime search and rescue cooperation mechanism.Although facing various hindering factors,positive promoting factors are also emerging and growing,so it is feasible to establish a regular maritime search and rescue cooperation mechanism in the South China Sea.This paper takes the cooperation mechanism of maritime search and rescue in the South China Sea as the research object,comprehensively explains the basic legal principles of maritime search and rescue cooperation,analyzes the current situation of maritime search and rescue cooperation in the South China Sea and draws lessons from overseas models.Finally,it puts forward its own ideas and suggestions on the construction of the cooperation mechanism of maritime search and rescue in the South China Sea.Firstly,the article makes a legal analysis of maritime search and rescue,and defines the concept of maritime search and rescue.Secondly,this paper analyzes the current situation of maritime search and rescue cooperation in the South China Sea,points out the reasons for the lack of maritime search and rescue cooperation in this region,and also sorts out the necessity and feasibility of maritime search and rescue cooperation in the South China Sea.Thirdly,the paper studies the construction process and main contents of the maritime search and rescue cooperation mechanism in the Black Sea region and the Arctic region,and puts forward the experience and lessons of the maritime search and rescue cooperation in the South China Sea brought by the maritime search and rescue cooperation in the two regions.Finally,on the basis of the foregoing,the paper makes two kinds of assumptions about the future maritime search and rescue cooperation mechanism in the South China Sea,both ideal and realistic,and puts forward some ideas on the specific construction content.
