Research On The Realistic Dilemma And Legal Path Of Public Participation In The Renovation Of Old Residential Area

With the continuous improvement of China’s urbanization rate,the construction of residential areas has also shown rapid changes.Some residential areas that have been built for a long time have been unable to meet the comfort and safety requirements of people’s living,so they need to be upgraded.The renovation of old residential areas is closely related to the vital interests of the public,so it is necessary to effectively attract the public to participate in the whole process of the renovation.However,in the process of promoting the renovation,local governments have not fundamentally changed the "all in one" situation.There are still some problems in public participation,such as low level,insufficient ability to participate,and imperfect institutionalized guarantee for public participation,As a result,the opinions of the public are ignored,resulting in conflicts of interest and affecting the progress of transformation.Therefore,under the current background of ruling the country by law,it is urgent to explore the establishment of public participation theory suitable for the transformation work,cultivate the public’s thinking mode of rule of law,and establish and improve the path of public participation in the rule of law.The research methods used in this paper include literature research method,interview survey method and comparative analysis method.There are six parts in this paper.The first part is the introduction,which introduces the origin of this paper,combs and summarizes the research at home and abroad;The second part is the related concepts and theoretical basis,which defines the key concepts involved in the article and introduces the basic theories used in this paper;The third part is the value analysis of the legalization of public participation,which analyzes the value of the legalization of public participation from the perspective of good governance and law;The fourth part is the empirical analysis of public participation in the renovation of old residential areas in R district,summarizing the renovation work of old residential areas in R district,and analyzing the practical difficulties and causes of public participation in the renovation of old residential areas;The fifth part is the experience of legalization of public participation at home and abroad;The sixth part is to improve the legalization path of public participation in the transformation of old residential areas.
