| Since the concept of rule of law government was first proposed in 2004,the transformation of government functions has always been one of the important connotations of the construction of rule of law government.The Fourth Plenary Session of the 18 th CPC Central Committee clearly put forward that "to comprehensively promote the rule of law,the foundation is at the grassroots level,and the focus of work is at the grassroots level." As the front-runner of the key work of changing the functions of the government,the grassroots government has been contributing to the construction of the rule of law government with rich practical exploration and experience accumulation,playing the grassroots effect of the main force and demonstration post,but at the same time,facing the many problems exposed in the transformation of the functions of the grassroots government,it also reflects to a different extent that the grassroots government is the weakest link in the process of changing the functions of the government.In 2021,the State Council "rule of law government construction implementation program(2021-2025)" clearly "by 2025,the government behavior fully into the rule of law track",the new period of the rule of law government construction,and even the transformation of government functions out of the new goals,new requirements,new ideas.So far,in the new situation,the transformation of grass-roots government functions into the rule of law track,the construction of the rule of law government as a perspective,continued in-depth research on the transformation of grass-roots government functions is of indispensable importance.This paper takes the construction of the rule of law government as the research threshold,defines the basic concepts of the construction of the rule of law government and the transformation of the functions of the grassroots government,clarifies that the transformation of the functions of the grassroots government should follow the basic principles of adhering to the leadership of the Party,putting the people at the center,the rule of law,and improving the efficiency,clarifies the interrelationship between the construction of the rule of law government and the transformation of the functions of the grassroots government,and points out that the transformation of the functions of the grassroots government is It is pointed out that the transformation of grassroots government functions is an inevitable requirement for the completion of the overall goal of rule of law government construction.The author selects T township as the research sample,and analyzes the basic measures taken by T township in the transformation of government functions and the effectiveness of the rule of law function transformation,and finds that there are problems in different degrees in the configuration,performance and supervision of functions in T township,such as the lack of legal authority,the lack of unity of authority and responsibility,the lack of administrative procedures in the performance of functions,and the lack of administrative participation and openness.It is not difficult to find out the root causes: insufficient supply of legal system,administrative due process does not go through the whole process of performing functions,insufficient rule of law capacity of administrative subjects,and ineffective supervision and assessment are the main causes of the dilemma of changing the functions of grassroots government.To solve the above dilemma,we should focus on legislation,procedures,subjects and other key links,take the new goals and requirements of the construction of the rule of law government under the new situation as the benchmark,establish and improve the legal and regulatory system for the transformation of the functions of the grassroots government,strengthen the construction of institutional mechanisms to match the powers and responsibilities of the grassroots government,and clarify that the transformation of the functions of the grassroots government should be based on the procedural guidelines of openness,fairness,guaranteeing the participation of the relative and efficiency.We will also tightly grasp the "key minority" of leading cadres,strengthen the construction of grass-roots rule of law talents and enhance the rule of law capacity of grass-roots workforce,stabilize the supervision role of key links,and give full play to the functions of government information disclosure and social supervision system.Although the study of the case study and practical experience of T Township is inevitably a generalization,we still hope that the analysis of the case of the rule of law in the transformation of T Township’s functions will contribute reference materials and provide experience for the rule of law path of the transformation of more township governments. |
