On The Principle Of Cyber Sovereignty In Building A Community Of Destiny In Cyberspace

The community of destiny in cyberspace is a new concept for building cyberspace security in the new era.The principle of cyber sovereignty is the first criterion for establishing a community of destiny in cyberspace,which is of great significance.With equal respect as the prerequisite,innovation and development as the source of power,common governance as the basic requirement,and security and order as the important guarantee,it provides fundamental guidelines for solidly carrying out the work of building a community of destiny in cyberspace in the new era.There are some dilemmas in the actual construction of the community of destiny in cyberspace,such as uneven development of cyberspace,cognitive differences among countries on cyber sovereignty,threats to cyber security and the lack of governance rules,etc.To effectively solve these dilemmas,the principle of cyber sovereignty must be adhered to.Based on the study of international official position papers on cyber sovereignty and the different statements and domestic legislation on cyber sovereignty in the United States,Russia,the European Union and China,we analyze the positive and negative promotion effects played in building cyberspace from different perspectives,and finally argue that the Internet should not and cannot be an "extra-legal space" separate from sovereign states "The insistence on the "return of cyber sovereignty" is in line with the inherent demand of the community of destiny in cyberspace.However,in the process of actual promotion,the realization of cyber sovereignty has been affected by many factors due to the lack of understanding of cyber sovereignty among countries.First,the transnational and global nature of cyberspace puts national sovereignty and national interests under great threat,so many countries hold a conservative attitude toward the principle of cyber sovereignty;second,the centralized nature of core resources and infrastructure in cyberspace and the shortcomings of the multi-stakeholder governance model make it difficult for countries to participate equally in Internet governance and international cooperation;in addition,the virtual and borderless nature of cyberspace makes the application of traditional jurisdiction extremely difficult.Finally,the technical and professional nature of cyberspace and the lack of clarity of relevant international rules make many countries face multiple dilemmas when exercising the right of self-defense,and the sovereignty and security of countries are difficult to be guaranteed.To this end,we should firstly insist on building a mutually respectful right to cyber equality,promote the internationalization process of ICANN,and build a cyberspace governance model based on sovereignty,so as to ensure that countries can participate in Internet governance on an equal footing;secondly,actively construct a right to cyber independence with innovative development implications,which includes the development of a worldwide,autonomous national autonomy to achieve At the same time,we will accelerate the construction of joint governance of cyber jurisdiction,adhere to the application of territorial jurisdiction in cyberspace,promote the construction of international collaboration mechanisms to combat transnational cybercrime,and ensure that countries effectively exercise their own jurisdiction,so as to form a common rule of governance in cyberspace;and finally,we will actively construct an innovative development of cyber independence,which includes the "root of interconnection" plan to achieve national autonomy worldwide,and accelerate the construction of network infrastructure to promote interconnection.Finally,peacefully construct a secure and orderly right to self-defense in cyberspace,including by insisting on the right to self-defense applicable in cyberspace,defining the forceful attacks committed through the Internet,and enhancing international cooperation to clarify the objects of the exercise of the right to self-defense.
