Research On The Coordination Mechanism Of IP Administrative Law Enforcement In The Yangtze River Delta

The three provinces and one city in the Yangtze River Delta are gradually promoting the new era of integrated development.Under the new development stage and the trend of new technology development,regional integrated development has also been endowed with new connotations.Because the integrated development of the Yangtze River Delta shows the trend and characteristics of symbiosis,co-construction and sharing,it is more necessary to actively promote the close coordinated action among the Yangtze River Delta regions.As an important part of social resources,intellectual property rights need to give more perfect provisions on intellectual property rights in order to make the allocation of resources reasonable.The Outline of the Plan for Regional Integrated Development of the Yangtze River Delta(hereinafter referred to as the Outline of the Integration Plan)clearly points out that "strengthening the joint protection of intellectual property in the Yangtze River Delta",that is,an integrated and coordination mechanism should be established in the protection of intellectual property.First of all,the necessity of the Yangtze river delta intellectual property administrative law enforcement coordination,from multidimensional analysis,Yangtze river delta of three provinces and one city local protectionism and uneven protection between regions,law enforcement coordination can overcome the differences in regional administrative law enforcement protection between three provinces and one city.Make full use of the advantages of administrative law enforcement coordination to make up for the lack of private law relief,improve the efficiency of administrative law enforcement and promote the development of intellectual property undertakings in the Yangtze River Delta.Again,it is pointed out that the difficulties faced by the coordination of intellectual property administrative law enforcement in the Yangtze River Delta,including the relevant policies of administrative law enforcement of the three provinces and one city,and the current coordination system of law enforcement coordination are imperfect,and some agreements involved are administrative agreements and have low effect.The absence of special normative documents makes the coordination mechanism of intellectual property administrative law enforcement not smooth,and makes it difficult to carry out cooperation in many law enforcement activities.The effectiveness of law enforcement cooperation is poor,the law enforcement cooperation team is short of resources,and there is no organization responsible for special law enforcement cooperation.The law enforcement object also affects the development of administrative law enforcement cooperation.In addition,the collaborative information sharing mechanism of administrative law enforcement is not perfect,and it lacks a timely,unified and effective information sharing mechanism.In addition,the three provinces and one city have intellectual property administrative punishment and illegal behavior discretion application standards are not unified,and the supervision mechanism is not perfect.Finally,it is proposed that the normative foundation of administrative law enforcement coordination should be consolidated and adjust policies for timely legislation.We will optimize an efficient collaborative working mechanism for intellectual property administrative law enforcement,enrich law enforcement teams,and raise consensus on the rule of law.We will improve the sharing of law enforcement information and supervision,expand the scope of information,and establish a regulatory system.At the same time,we should unify administrative penalties and discretionary standards for illegal acts,and strengthen the supervision of administrative law enforcement.Fully summarize the intellectual property administrative law enforcement in the Yangtze River Delta region,and establish a cooperative mechanism of intellectual property administrative law enforcement compatible with the integrated development.
