In the face of the increasingly severe aging situation,the Party and the state actively take active actions to respond to social concerns.As early as 2011,they proposed to establish a "social pension service system",aiming to solve the practical dilemma of insufficient family pension capacity and the increasingly serious pension problem.At present,"coping with the aging of the population" has been promoted as a national strategy,explore the correct way to solve the pension dilemma,and effectively ensure that the elderly group can "support",the construction of the pension law is very important.However,the legislation involving social elderly care services,both at the national and local levels,urgently needs to be further improved.Specifically,at the national level,there is only one law on the Protection of the Rights and Interests of the Elderly,lack of specialized "social pension service" legislation,which cannot guide and regulate the legislation,lack of coordination with the personnel training,financial support,supervision and management of social pension service,which seriously blocks the development of social pension service in China.In view of the above problems,this paper first of the legislative situation of social pension service in China,and then from two aspects of structural and content analyzes the problems existing in the current legislation,the relevant scholars and foreign practical experience of social endowment service legislation,to improve the social endowment service legislation,improve the level of social endowment service legalization,to cope with the population aging,promote the healthy development of pension service,provide legal guarantee.
