| In recent years,armed conflicts,war issues,and other frequent occurrences have led to the emergence of a large number of refugees worldwide.The high welfare system in Europe attracts refugees seeking relief,but years of refugee crises have made it slightly difficult for Europe to accommodate and accommodate more refugees.The Blue Book of the China International Migration Report(2015)points out that the number of people applying for refugee status in China is constantly increasing,and China has also become one of the target countries for asylum seekers.China is a signatory to the 1951 Convention relating to the Status of Refugees and the 1967 Refugee Protocol,assuming international obligations for refugee protection.However,currently,China does not have a dedicated refugee law or a comprehensive legal system for refugee protection.How China can regulate the reception of refugees in the face of future refugee asylum work is a problem.Therefore,it is necessary for China to improve its legal system for refugee protection.The study analyzes and explores four aspects: an overview of refugee issues,the evolution of China’s refugee protection legal system,the current situation and difficulties of China’s refugee protection legal system,and the international refugee protection legal system.Starting from the basic concept of refugees,this paper sorts out various existing refugee groups,analyzes the various impacts that refugees have on the host country,and clarifies that the group that China grants legal status to refugees is only political refugees.On the basis of clarifying the protected objects,this paper analyzes the difficulties in China’s refugee protection legal system,combines past experience in assisting refugees,and examines the experience of the international refugee protection legal system to explore how to improve China’s refugee protection legal system.This study starts with the current situation of the legal system of refugees in China,discusses the existing system difficulties such as not having a clear definition of refugee,not having clear authority of refugee affairs,lack of screening procedure and content of refugee resettlement,and further analyzes the reasons of China’s basic position on the treatment of refugees.It deeply analyzes the reasons for China’s basic stance towards refugees.On this basis,the following improvement paths are proposed for China’s refugee protection legal system:Firstly,determine the legal construction approach for China’s refugee protection system,while adhering to the principle of national sovereignty,recognize the principle of "common but differentiated" responsibility,while also focusing on assisting Asian refugees;Secondly,the main body of the refugee protection system should be determined,and China should bear the international obligation to assist political refugees,while clarifying the responsibilities between various competent agencies to prevent inaction;Thirdly,improve the refugee screening procedure,and on the basis of clarifying the scope of protection objects,roughly formulate the general procedure for refugee screening,considering refining existing legal provisions;Fourthly,clarifying the content of refugee resettlement can rely on internet platforms to innovate the general resettlement and resettlement content of refugees,and encourage refugees to seek a happy life;Finally,we need to strengthen cooperation both domestically and internationally.The Chinese government should learn from the strengths and weaknesses of non-governmental charitable organizations,and cooperate with international organizations such as the United Nations High Commissioner for Refugees to help each other and work together to solve refugee problems.Of course,the fundamental measure to solve the refugee problem is to promote peace and stability in the country of origin of refugees through international peace consultation and dialogue,achieve voluntary repatriation of refugees,and reduce the size of refugees from the root cause.Through the above five suggestions,we aim to provide ideas for improving China’s legal system for refugee protection,strengthening China’s management of refugee affairs,seeking to move the refugee issue in the opposite direction,and achieving global peace and stable development. |
