Administrative interviews are an important administrative tool that differs from traditional administrative actions and is an efficient and flexible tool in the government regulation toolbox.However,in recent years,while administrative interviews have played their institutional advantages in achieving administrative goals,they have presented two major issues of standardization and implementation,which urgently need to be adjusted and resolved.At present,it is of great significance to improve the administrative interview system in the process of promoting the comprehensive rule of law and the construction of a government ruled by law.The first part of this article is an introduction,which includes the following content:firstly,the proposal of research questions.The second is to introduce the research background of this article.The third is to elaborate on the research significance of this article.The fourth is a review and summary of domestic and foreign research on the administrative interview system.The fifth is to explain that the research methods used in this article are different from previous ones,including literature analysis,comparative research,and case analysis.The second part of this article is a theoretical overview of the administrative interview system.Firstly,by reviewing the origin and development process of the administrative interview system,a preliminary exploration was conducted on two aspects: institutional advantages and practical difficulties.Secondly,the concept analysis and legal attribute exploration of administrative interviews.Once again,in order to gain a more comprehensive understanding of the overall situation of administrative interviews,the basic structure of administrative interviews was explored,which is divided into four parts:the subject of administrative interviews,the object of administrative interviews,the scope of application of administrative interviews,and the general procedures of administrative interviews.Finally,it explains the theoretical basis of administrative interviews,including the Balance theory,the theory of co construction,co governance and sharing,and the theory of consultative democracy.The third part of this article is an examination of the administrative interview system and its practical operation.This part aims to analyze the main existing problems based on the examination of the administrative interview system and its practical operation.There are five main problems: insufficient legal basis,punitive nature of interviews,mandatory nature of interviews,excessive nature of interviews,and difficulties in the effectiveness of interviews.The fourth part of this article is the path to improve the administrative interview system in China.Based on existing theories and specific problems in the operation of the administrative interview system in practice,from the perspectives of theoretical approach,institutional construction,and practical approach,this article proposes ideas and suggestions for further improving and optimizing the administrative interview system,in order to promote the legalization process of administrative interviews in China.
