In recent years,from central to local levels,more and more administration departments used to employ "administrative interview" to carry out management,supervision and other duties.This reflects the tendency of flexible executive practice.And it meets the requirements of service-oriented government concept.But as a new type of administrative law enforcement,its theoretical research is not enough.The author will evaluate the interview in practice,point out some problems in practice and put forward some suggestions about how to perfect the interview.The structure of this paper is as follows:The first part introduces interviews in administrative process.Firstly,the paper analyzes the connotation of the administrative interview use a method of description.Then enumerates the various administrative fields,including the Internet field,the field of Consumer Rights Protection and the field of Environmental Protection.Then the process of interview is introduced,including the preparation process,the implementation process,follow-up processing process.The second part of the administrative interview for theoretical positioning.The article regards administrative interview as a kind of new law enforcement means with negotiation.It has the investigation and evidence collection,prevention and suppression,illegal caution,law enforcement reconciliation,decision-making advice and other functions.Interview behavior and follow-up behavior is also inseparable.The third part evaluates the implementation of administrative interview.The motivation mechanism of the interview is that it can benefit both the administrative subject and the relative.Interview failure,including fail to start the interview,did not reach a satisfactory,after the interview issues still exist.Interview failure mainly due to the lack of supervision of the interview process,and the low-level legislation.The fourth part points out the problems in practice.In practice,the interview is excessive,arbitrary,mandatory and so on.In addition,the administrative counterparts and the executive body of the ability to negotiate between negative relative and the executive.There are many issues also worthy of attention.At last,some suggestions are put forward for the problems in the interview practice.Improve the means of interviews need to establish monitoring and relief mechanisms.Internal Complaint System and Administrative Proceedings Confirming Illegal Judgments can point a way to whom has been infringed in interview process.
