Research On The Legitimacy Of The Mode Of "Cross-serving Of The Two Village Committees"

Village party organizations and villagers committees are an important part of village-level organizations,and they are also an important subject to realize the modernization of rural governance and implement the rural revitalization strategy.In order to ensure the leadership of the village party organization over the village committee,the "Strategic Plan for Rural Revitalization(2018-2022)" pointed out that the model of "cross-serving of the two village committees" should be vigorously promoted.The model of "cross-serving of the two village committees" conforms to the goals and requirements of the modernization of the national governance system and the basic requirements of the principle of proper function and the principle of streamlining and efficiency;it conforms to the Organic Law of Villagers Committees,the Regulations on the Work of the Communist Party of China in Rural Areas,and the Organizational Work of the Communist Party of China at the Rural Levels.The relevant provisions of the Regulations have the basis of legitimacy;and in the implementation,they have achieved the effect of strengthening the overall leadership of the village party organization and easing conflicts between the "two committees" of the village.However,there are illegal problems in the specific implementation of this model: First,the model of "cross-serving of the two village committees" is not the only way to achieve the village party organization leading the village committee.The village party organization can also lead the village committee through the village secretary.The village director is held by different people,and the village secretary leads the village director to implement specific tasks.Whether or not to adopt this model should be carried out according to the actual situation of the village.Forcible implementation of this model in some rural areas is prone to illegal problems.Secondly,the operation of the model of "cross-serving of the two village committees" should be combined with the practice of villagers self-governance.However,in the operation of this model,there are phenomena such as "bribery of elections","single words in decision-making" and "excessive concentration of power",indicating that the operation of this model The mechanism is not perfect.In this regard,the supervision role of local people’s congresses and grass-roots discipline inspection commissions should be strengthened in accordance with the "Rural Revitalization Promotion Law","Organization Law of Villagers’ Committees","Chinese Communist Party’s Rural Work Regulations" and other legal norms and intra-Party regulations.Improve the election mechanism of the village "two committees",the village-level democratic decision-making mechanism with the participation of multiple subjects,and the village-level power operation supervision mechanism to ensure the legal and effective implementation of the model of "cross-serving of the two village committees".
