| The promulgation and implementation of programmatic documents related to major administrative decision-making and the successive promulgation of government regulations or normative documents in various parts of the country demonstrate that my country’s guarantee system for major administrative decision-making processes is increasingly complete.In order to promote the construction of a rule of law government to be more effective,the Central Office for Governing the Country by Law will release the "Demonstration Indicator System for the Construction of a Rule of Law Government in Cities and Counties" in 2021,which aims to assess the construction of a rule of law government in various regions through indicators.Based on the requirements of the index system,this paper uses the performance evaluation method to study the scientific,democratized and legalized institutional guarantee of the major administrative decision-making of the sample Xi’an municipal government.The municipal government and its subordinate governments generally have the following problems: the catalogue of major administrative decisions is a mere formality;the supervision of the National People’s Congress and its standing committee is not disclosed;the procedural rules for experts to participate in the demonstration are blank;the steps of risk assessment are not clear.There are three reasons for analyzing the above system defects: the concept of "emphasizing substance over procedure" is deeply rooted;legislative vacancies in related systems;and resource constraints.Targeted improvement suggestions include: strengthening publicity and education,raising awareness of the rule of law in decision-making procedures;strengthening legislative supply;and rationally allocating administrative resources.After comparing the system development differences between the two different regions,the following suggestions for promotion are drawn: applying government big data in the evaluation of the rule of law government;implementing national-level legislation on the issue of lifelong accountability for major administrative decisions;conducting regional pilots for immature systems. |
