It is necessary to "put the non-litigation dispute resolution mechanism in the forefront",this is General Secretary Jin-ping Xi Emphasis at the Central Conference on Political and Legal Work.Rural people’s mediation is an important means of resolving disputes at the grass-roots level,since its birth,rural people’s mediation’s value has changed from a simple dispute settlement system to an important grass-roots governance mechanism.As has been proved in practice,rural areas are the foundation of social governance,which can not be ignored.It is easy to breed interest conflicts and cause social contradictions.Therefore,coordinating interest relations and resolving social contradictions in rural areas is the key link of grassroots governance.With the promotion of market economy and the development of rural transition,rural disputes also from the traditional marriage and family disputes,neighborhood disputes and the dispute of creditor’s rights debt,the traditional dispute gradually appeared with marketization,urbanization and modernization,such as rural land contract disputes,Labor rights disputes and pollution of the environment infringement,the rural disputes tend to be diversified and complicated,it tests the ability of rural mediators,effectively reduce rural disputes and it has become the key to maintaining social stability,promoting the regional development.Based on five typical rural people’s mediation cases in X Town,F City,author uses the following methods including case analysis,data comparison,interviews to analysis the reality of traditional and non-traditional disputes at this stage of change,and combining with the basic situation of the people’s mediation committee at the township and village levels in X Town.Author also narrate the mediation process of five cases from the first person point of view of the mediator conducting the mediation.From the practical practice and logical sequence from the occurrence of conflicts to the solution,this paper summarizes the realistic dilemmas that are outstanding in the operation of rural people’s mediation,including the work of village people’s mediation committee is weak,the work of rural people’s mediator is not precise,the linkage effect of departments is not good,and the mediation agreement is difficult to reach and perform.Then explored the existing reasons from a deep level.Through the above analysis,We can adopte optimization strategies from four aspects,namely,promoting the standardized construction of mediation committees,strengthening the construction of full-time mediators,establishing a long-term coordination mechanism between departments and establishing the mechanism to promote the implementation of mediation agreements.Specifically,it will strengthen the organization and leadership of "Fengqiao experience",improve the reward and punishment mechanism for the assessment of mediators,the government’s purchase of people’s mediation services,implement the cooperative governance model and improve the judicial confirmation system.It aims to provide bettersolutions for the difficulties and pain points encountered in the current grassroots social governance,to promote the creation of the new era of "Fengqiao style judicial office",innovate the governance model,serve the vast countryside,promote social harmony and stability,build the people’s mediation to maintain the grass-roots harmony and stability of the "first line of defense",so that the people better enjoy the fruits of social governance.
