Although our country’s e-commerce starts later than the European and American countries,but after the rapid development in recent years,china’s e-commerce in the online retail market,the number of online shopping,digital express business and mobile payment scale ranks first in the world.The supervision of e-commerce in our country is groping along the road of development and governance.The implementation of e-commerce law has ended the jungle-like development era of“Barbaric growth” of e-commerce industry,it means that the business model of our country’s e-commerce has entered the scope of legal supervision.However,the complexity and changeability of e-commerce continue to pose new challenges to our government regulation,for example,in recent years,the number of malicious disputes and lawsuits which deviate from the original legislation by means of“Notice-deletion” rule and regulatory loopholes has increased instead of decreased The illegal person attacks the competitor maliciously,seeks the improper benefit to cause the electronic commerce platform operator benefit imbalance question to be more prominent.The emergence of unbalance of operators’ interests in e-commerce platform shows that there are still many deficiencies in our government’s supervision of e-commerce,which need to be further optimized and improved.Based on the theory of interest measurement and a large number of cases,this paper makes a qualitative analysis of the unbalanced interests of the operators in e-commerce platform,and analyzes the unbalanced interests of the operators in e-commerce platform and Z company,this paper concludes that the interests imbalance of operators in e-commerce platforms is mainly caused by the following categories of stakeholders: malicious defenders,e-commerce platform operators and some laws and regulations,research shows that when the imbalance reaches a certain limit,it will destroy the stability of the entire e-commerce industry.Based on the analysis of the current situation of e-commerce regulation in China,this paper points out that there are three major problems in our government regulation,namely,the regulation efficiency needs to be improved,and the system of government regulation and the system of protecting the rights of government regulation are not perfect.On this basis,taking z company as an example,the paper draws the conclusion that the change of government supervision has a great positive effect on the correction of the imbalance of operators’ interests in e-commerce platform,then it shows the necessity of optimizing government supervision.Research shows that this imbalance can not be self-regulated by the market economy,the government needs to take the initiative.Through the training of e-commerce administrative supervision backbone personnel,innovation in government supervision concept,upgrade governance technology,strengthen the crackdown to enhance the effectiveness of government supervision;Supplement and perfect the law of e-commerce supervision,construct the rule of judgment of interest-weighing thinking program,promote the system of coordination governance and network supervision,and perfect the system of government supervision To optimize the system,we should open up the channel of protecting the rights of the operators in e-commerce platform,build a reciprocal bilateral credit evaluation system,strengthen training and improve the ability of protecting the rights of the operators in e-commerce platform.Through the above three aspects of the optimization of countermeasures to correct the imbalance of interests of operators within the e-commerce platform,to promote our e-commerce industry to further sustainable and stable development.
