An Empirical Study On The Value Cognition Of Legal Justice

Law is the product of the development of human society.The introduction of legal system contains people’s pursuit of certain value.However,at present,some laws intended to solve social problems have generated certain doubts in the society after their promulgation,which cannot be widely accepted and recognized by the public.The reason is that due to the difference in value cognition,relevant departments tend to ignore the most important justice value contained in law based on their own interest demands,resulting in a certain impact on citizens’ rights and obligations,which goes beyond the citizens’ perception of justice.Theoretically speaking,the value of justice is the value closely related to citizens.If the legal system cannot satisfy citizens’ cognition of the value of justice,citizens will not feel the justice of the system,so it is difficult for the system to be accepted and recognized by citizens.From the actual situation,if the legal system wants to obtain the acceptance and recognition of citizens,it needs to start from the perspective of citizens and analyze the value cognition of citizens through scientific methods,so that the enactment of laws can conform to the cognitive consensus of citizens.According to the study of legal value by scholars,we can find that the legal value generally includes order,freedom,justice,equality,efficiency and human rights.Based on scholars’ research on legal value,a scale of legal value is developed to measure citizens’ value cognition.Through sociological investigation,we can find that justice value is not only the core value discussed by scholars,but also the value with the highest cognitive coefficient of citizens.In the value cognition of citizens,the value of justice plays a very important role,justice is the core value of law.What is the relationship between the value cognition of justice and other value cognition of citizens? From sociological investigation and analysis,we can see that although there are some differences in the value cognition of each individual,citizens’ perception of justice value plays an important leading role in other value cognition,and satisfying citizens’ perception of justice value is the basis for reaching other value consensus.When the pursuit of other values satisfies citizens’ perception of justice,Only in this way can citizens reach a consensus on this value,and only in this way can laws containing this value be accepted and recognized by the public.The value cognition of citizens will affect their legal practice.The value of justice,as the value with the highest degree of citizen recognition,should give full play to its leading role in the legal practice of citizens.The value of justice should be integrated into the whole process and stages of the operation of the rule of law,and citizens’ awareness of the value of justice should be enhanced in the legislative,judicial and rule of law education,and citizens’ awareness of the subject and their rights and obligations should be enhanced,so that citizens can feel fairness and justice in every legal system and judicial case,and be able to consciously abide by and believe in the law.
