Market economy is the rule of law economy,contract is an important form of economic communication between modern enterprises,one of the important subjects of enterprise management is contract management,in order to improve the core competitiveness of enterprises must improve the level of contract management,in the daily management of enterprises to prevent legal risks.Taking the contract management of Y Company as the research object,this paper reveals the risk points in contract management and its importance in enterprise management by reading and studying relevant literatures at home and abroad and drawing on the theoretical basis of contract management and contract legal risk management.Secondly,case analysis and questionnaire survey are used to analyze the current situation of Y Company’s contract management and find the problems existing in Y company’s previous contract management.Then,fish bone analysis was used to analyze the causes of the problem.Finally,provide Y company with the improvement measures of contract management and evaluate the implementation effect.The first chapter of this paper introduces the background and significance of the topic selection,collates and summarizes the existing research at home and abroad,and introduces the research content and research methods of this paper,including questionnaire method,case analysis method,fishbone analysis method.The second chapter of this paper defines the relevant concepts of contract and contract management,introduces the theoretical basis of contract management theory,contract risk management theory and other relevant theories of contract management,so as to facilitate the analysis and research on the current situation of Y Company’s contract management on the basis of the defined concepts and theoretical basis.The third chapter of this paper introduces the current situation of Y Company’s contract management.Through case analysis,it is found that Y Company’s contract management has some problems in the signing of contracts,such as not being reviewed by professionals,lack of countersigning,inversion of signing and unclear terms.In the process of contract performance,there are problems such as not paying attention to written evidence,not supervising execution in time,and staff slack in their work;Problems such as lack of active communication,lack of awareness of evidence,and delay in dealing with problems in the process of contract modification and termination;In the contract dispute link,there are problems such as late legal intervention,management staff slack off,respect human relations and so on.The fourth chapter sorted the importance of the problems affecting the contract management of Y company through the analytic hierarchy process,identified the four important problems in the contract management,and further understood the current situation of the contract management of Y Company through the questionnaire survey.The fifth chapter,through fishbone analysis,analyzes the reasons for the problems in each link of Y company’s contract management: First,the relevant personnel lack of legal awareness;Second,the contract management system is not perfect;Third,the level of contract management information is low;Fourth,the professional quality of contract management personnel is not high.The sixth chapter of this paper,through the above analysis and research,puts forward the following improvement measures for Y company’s contract management system: first,establish the consciousness of contract management;Second,develop a perfect contract management system;Third,improve the level of contract management information;Fourth,establish an efficient contract management personnel system.At the same time,the effect of the improvement measures after implementation is evaluated.The last chapter summarizes and evaluates the research of this paper,and prospects the future research of contract management.The study of Y Company’s contract management in this paper not only enriches the case base of contract management,but also improves the company’s contract management level,cooperation efficiency and effective protection of its own legitimate rights and interests,which has important strategic significance for the development of the enterprise.At the same time,it also hopes to provide reference and inspiration for the contract management of other companies in this industry.
