Research On Intellectual Property Protection Of Agriculture Based On The Supply Of Public Goods Theory

Whether it is from domestic reality or abroad practice, in the perspective of public goods supply theory, agricultural intellectual property protection is an important topic with realistic meaning and urgency. Most recent research targets on system research, mainly relates to the field of law. Yet research in the view of economics is not much, especially for agricultural intellectual property protection has not been studied deeply. In China, research on agricultural intellectual property protection by using public goods supply theory is still the blank, no matter from government or from scholars. As intangible property rights, intellectual property rights is a kind of economic resource, the objective of resource allocation optimization is to minimize the macro-economic waste and to realize the welfare maximization. Based on this, this paper uses the institutional economics, welfare economics, game theory, in the perspective of public goods supply theory, provides theoretic analysis and empirical analysis on the agricultural intellectual property protection.On the theoretical level, the paper is to clarify difference and relationship between general agricultural intellectual property protection and public goods perspective agricultural intellectual property protection. Intellectual property is a civil rights, which is characterized by the exclusive, but with smallholder Chinese history, farmers decentralized situation, Chinese intellectual property shows its particularity. In current situation, we must take the whole agriculture intellectual property as public goods to supply, to achieve allocation of resources optimization. Therefore, the paper gives three modes of agricultural intellectual property rights protection, government supply model, economic organization supply mode, and non-economic organization supply mode. Agricultural intellectual property effective supply should be dominated by government supply, three modes complement each other to achieve.On the empirical level, by absorbing the research results at home and abroad on agricultural intellectual property protection, the paper dissects deeply existing problems in our country, on the basis of roots cause, to agricultural technology protection example, then puts forward practical measures on how to strengthen agricultural intellectual property protection in our country.The paper extends the research perspective of agricultural intellectual property protection, views and ideas of public goods supply and supply mode selection on agricultural intellectual property protection will provide beneficial inspiration to solve Chinese present agricultural intellectual property situation.
