Study On Defining And Allocating Forestry Carbon Sequestration’s Property Rights

Forestry Carbon Sequestration is a kind of ecological service provided during tree growth, originating from trees’biological property to absorb CO2and release O2. In the context of global climate change, the role of this service in mitigation of greenhouse effect is recognized by international rules, and can be traded under the constraint of trading rules to achieve its economic value. Clarification of Property Rights to Forestry Carbon Sequestration is in favor of property subjects to the actual control of the service to meet their needs through exercising the rights. However, this service forestry carbon sequestration provided has no physical form, and requires the presence of trees and other material support in order to perform its functions. In addition, the transfer of Forestry Carbon Sequestration Property Rights will cause separation of property rights between Forestry Carbon Sequestration and forest. This leads to the special process of defining rights. Implementation of property rights and interests is another important problem of property rights of Forestry Carbon Sequestration. The main contents are as follows:First, in this research, related concepts of forestry carbon sequestration property rights were defined and described. The Forest Carbon Sequestration refers to the incremental carbon sequestration through afforestation, forest management and other measures of reducing carbon emissions through conservation of woodlands, wetlands and other acts. It is a kind of ecological service or ecological product. Its value correlated with the value of greenhouse gas emissions space by forest’s absorption and fixation of carbon. Property Rights of forestry carbon sequestration is defined as a bunch of rights to the forestry carbon sequestration of the property owner acquired by laws or regulations, including the function of possession, use, benefits and disposition. It is the economic rights relations around forestry carbon sequestration. Forestry Carbon Sequestration property rights belong to the scope of Real Rights. It is closely related to the Forest Rights but should be defined separately so that the subjects can exercise the rights.Secondly, the research further analyzes the subject,object and basic functions of forestry carbon sequestration rights. Property rights subject owns the rights with various purposes. The access to forest carbon sequestration can be in accordance with the agreement between the parties or in accordance with the provisions of natural fruits in the Real Rights Law. The objects include the technical elements, the price elements, the use value element, and ecological services elements. The subject can not fulfil the rights and interests untill they obtain the property rights in legal way, measure and register Forestry Carbon Sequestration based on complete clarifying procedure. The study analyzes the game on utility in the public domain of property rights of forestry carbon sequestration by constructing Bayesian Nash equilibrium model to analyze and verify it. The results show that the information disadvantaged’s participation in the game will be influenced by the utility caused by composing elements of forestry carbon sequestration and the cost to obtain these utility.Fourth, Allocating of property rights is the important condition of realizing the rights and interests of Forestry Carbon Sequestration property rights. China’s forestry carbon sequestration potential supply during2014and2025, and potential emission of Greenhouse Gas during2005-2020is estimated. Then the potential demand of Forestry Carbon Sequestration is anticipated. After analyzing the present allocating situation, research finds that it is difficult to allocate the Forestry Carbon Sequestration, which is bad to the realization of rights and interests. At present, allocating China’s forestry carbon sequestration based on public welfare behavior will attract more sources to carry out the project. And it is the effective way to allocate.Fifth, the study analyzed property rights issues in the public welfare forestry carbon sequestration projects. According to the features of public welfare projects, the research analyzes and concludes4methods to deal with the the property rights of public welfare forest carbon sequestration, sums up the advantages and disadvantages and the characteristics of these means. After that, by analyzing our public welfare forest carbon sequestration projects actual case, the results of the previous study were tested and verified. In this research, the following conclusions are made:(1) Forestry carbon sequestration is the substance without natural body, formed during trees’ growth, and is the forest’s natural fruits. Its property rights should be defined specifically from the real right perspective.(2) The target product of forestry carbon sequestration property transactions is essentially the space of Greenhouse Gas emissions. In order to trade Forestry carbon sequestration rights, it is necessary to clarify the rights through a complete procedure to make the rights clear.(3) Increasing the utility of forest carbon sequestration, and reducing the cost to obtain the value of composing element is in favor of the incentives for rights subjects to participate in forest carbon sequestration property game. This is the important condition for realizing the rights and interests of forest carbon sequestration property rights.(4) The rational allocation of property rights benefits the realization of its rights and interests. Due to the unmet conditions to allocate the rights through market transactions, how to get more resources (mainly money) will result in higher allocating efficiency.(5) Public welfare forestry carbon sequestration project can obtain more resources to carry out projects by designing allocating methods, which makes the allocation more efficient.Finally, according to the analysis and conclusions, the study present the proposals of the management and use of forest carbon sequestration:(1) The property rights system of forestry carbon sequestration should be improved.(2) Set up the principle of priority for the use of forest carbon sequestration.(3) Utilize the public welfare behavior to promote the development of farmer’s forest management carbon sequestration projects, and increase the types of projects.
