The Research Of The National Sovereignty Problems In The Process Of Global Integration

Sovereignty in international law is a major issue of the theory and practice of international law; it is also a controversial one. When globalization becomes irreversible, sovereignty again turns into the disputes in various countries. Since in the process of globalization, all the nations will exert all their best to fight for their interests despite their different situations in each country. Therefore, sovereignty is the inevitable topic in the course of globalization, not only the weak powers are under the pressure of national sovereignty, but also are the strong powers. And so sovereignty in the progress of globalization should be the issue that is eager to be settled both in theory and in practice.Since the theory of sovereignty came into being, there have been various kinds of opinions and sayings from different aspects and positions, even from the controversial theory. After years of practice in international relations and communication, a more systematic theory of sovereignty has been formed. In spite of the so many drawbacks as the lack of clear and concise definition, it is still the theoretical foundation of modern international law. And the sovereignty on this basis has been viewed as the life by most nations, but obstacles by some other countries. By exploring this reality, we can find out that this confusion in international relations and international communication has just resulted from the inadequacy of sovereignty theory. When we introduced the concept of sovereignty rights into sovereignty theory, we can see that in fact sovereignty is not the real entity right in law sense, but a superior and more abstract kind of right. What a nation advocates or exercises in international relations and international communications are the sovereignty, and this is the point.The concept of theoretical sovereignty right in international law is the new issue that all nations encounter and the key of challenge in the course of globalization. Globalization becomes the inexorable outcome of international cooperation since it is the international cooperation that results in the appearance, the development, and fusion of globalization. In such field as economy, politics, law and culture, there is the trend of globalization. In the fight against terrorism, global military cooperation has been launched. Despite the differences in the cause, the form and the level of globalization, they have carried the course of globalization to the stage of global administration to various extents.In fact, the new problem and challenge with which all sovereign nations are faced in the course of the development of globalization are the issues on how to give up, resign sovereign authority and how much they should give up and resign. This has been proved in the process of European globalization. Europeanization aims to realize the enduring peace and development. Starting from international cooperation, they constantly give up and resign sovereignty to change the situation in which all countries manage together into Europeanization in many fields, and then into a more advanced form—European Alliance. The development of Europeanization not only demonstrates the means of integration but also displays the laws of integration. And this fully proves that the development of integration can be realized only when we can persist in the principles of sovereignty and equality. If we compare process of globalization with that of Europeanization, we can see the similar objectivity. Of course globalization is no better than Europeanization, which shows that it is very difficult to implement and adhere to sovereignty in the whole world. It is the essential precondition and necessary factor to realize the real equality and to wipe out the international hegemony in the course of globalization. Only under such condition can we see the abandon and resign of sovereignty so as to establish a more stable and enduring peace and development and to have a normal order in international law.Globalization has given China a golden opportunity with which we can seize the chance of development, and even can solve many home and international problems such as the issue of Taiwan. Hence, China should handle globalization with ease, take part in it with initiatives and promote it with efforts.
