On The Issue About European Integration And The Nation's Sovereignty

Along with the close international association and cooperation,the traditional theory of sovereignty is changing,of which the remarkable feature is sovereignty transfer,consistent with the tide of globalization.EU,as a regional international organization with the full development of economic,political of integration,plays an important role in the world.The process of Europe Integration offers us the very opportunity to study the limited amortization of the nation's sovereignty in international law.There is a phenomenon in the process of Europe Integration,namely the shift of nation's sovereignty and function to supranational constitute.It extends the activity space of the sovereignty via exercising sovereignty together through collective way.This thesis will interpret explicit issues as follows:How to deal with the relationship between supranational institution and member countries? Why member states are willing to sacrifice their nation's sovereignty? How to transfer the nation's sovereignty among the member countries? And,is there any difficulty in this process? Besides,as the high light of this thesis,it dwells on the significant action of the constitutionality of EU,which pushes on the Europe Integration.From perspective of the constitutionality of EU,the author examines the relationship between the constitutionality of EU and nation's sovereignty in the process of Europe Integration by analyzing the reasons and the significances in the constitutionality of EU,as well as analyzing the crisis of drawing Up a constitution.Finally,this thesis carries on a reflection on Europe Integration,from which the author found that it not only sets a good example for the development of the regional integration and aggregation around the world,but also brought a significant enlightenment which can be a guidance for China when it participates the international system and the regional integration in the tide of globalization.This thesis consists of introduction,text and conclusion.The text includes four chapters.The first chapter introduces basic theories relating to nation's sovereignty, including its origin and development,the challenge to the traditional theory of sovereignty in international law in the tide of globalization and the problems about sovereignty transfer,which is the new development of this theory.The second chapter,by examining the theories of the nation's sovereignty in the process of Europe Integration,exposes the substance of the nation's sovereignty transfer and introduces how to transfer the nation's sovereignty by the member countries.Then,this chapter conducts the importance of constitutionality of EU through analyzing the dilemma and the setback in the process of Europe Integration.The third chapter is the emphasis of this thesis,which mainly presents the relationship between the constitutionality of EU and the sovereignty of member countries.The author points out the importance of the constitutionality of EU in the process of Europe Integration with the analysis and reflection on the crisis of drawing up a constitution in the course of this,by introducing the reasons and significances of the constitutionality of EU.The fourth chapter is the last part,which mainly brings out some reflection on the nation's sovereignty transfer in the process of Europe Integration.
