So far, the research of the Puppet Mongolian Regime focuses major attention on the Japanese invasion into its politics, economy, and culture, etc. while the promotion of its colonial policies by legal means is left unnoticed. This paper touches upon the legal field, focusing on Japan's promotion of its colonial policies and its hindrance of the legal modernization of Inner Mongolia, and selects five different persepctives:legislation, administrative legal system, economic legal system, penal code system and judicial system, to clarify the legal system of the Puppet Mongolian Regime, illustrate its major features and underlying reasons, point out its damage to Inner Mongolia by acting as the tool of Japanese invasion, and expound the hindrance of Japanese invasion toward the legal modernization of Inner Mongolia.Chapter One:Legislation of the Puppet Mongolian Regime. Focusing on the legal compilation "Collection of Mongolian Legal Regulations" by the Puppet Mongolian Regime and by means of textual analysis, this chapter illustrates the different stages of legislation of the puppet regime, summarizes its basic forms, clarifies the various laws and legislative procedures and summarizes the puppet legislation as borrowism, colonialism, feudalism and administrative centralism.Chapter Two:the Legal System of the Puppet Mongolian Regime. Based on the clarification of the administrative law of the puppet regime, this chapter analyzes its main features, and summarizes these features as colonialism and feudalism, pointing out its serious defects compared with modern administrative laws.Chapter Three:the Legal system of the Economic Manipulation of the puppet regime. Focusing on the Japanese savage plunder of the Mongolian natural resources, this chapter illustrates the legal system of commodity manipulation, of labor manipulation, and of financial manipulation. By laying the puppet legal system in the whole social context, this chapter, using all kinds of cases, events, makes a thorough survey of the implementation of the system, and summarizes its significant damage to the region.Chapter Four:the Criminal Law System of the puppet regime. Based on the theories of the criminal law, this chapter analyses the organization of the criminal law of the puppet regime, illustrates its main content, and, by centering on the special criminal law of the puppet regime, analyses the strengthening of the rule by Japan in Inner Mongolia with the help of the criminal law, and further reveals this role of the criminal law in the following aspects:lack of supervision in terms of the stipulation of the criminal law, severe punishments taking the place of light ones, and combination of Mongolian and Han means.Chapter Five:the Judicial System of the puppet regime. From three different angles:judicial system, criminal lawsuit system and prison system, this chapter restores the original panorama of the judicial system of the puppet regime, illustrates its colonialism, and reveals its darkness.Chapter Six:Conclusion:the Essence and Functions of the Legal System of the puppet regime. From four perspectives:administrative law, economic manipulation law, criminal law and judicial law, this chapter makes a profound exposition of the essence of the legal system of the puppet regime as a vehicle for promoting Japanese colonial policies. In addition, by putting this legal system in the whole context of the modernization process of Inner Mongolian legislation, and comparing it with the system implemented before the1911Revolution, this chapter, from the following three points:administrative law, criminal law and judicial law, illustrates the hindrance of this legal system toward the legal modernization in this region.Compared with the previous researches in this field, this paper has made breakthrough in the following three aspects:1. Expansion of the research realm. This paper conducts its survey from the legal point of view, expanding the range of research of the puppet regime, far deeper than the previous studies, which concentrate mainly on the politics, economy, culture and education of the Japanese imperialism.2. Originality of the perspective. This paper centers on an overall investigation of the implementation and impact of the legal system of the puppet regime, as well as its historical depiction. Furthermore, by studying the legal system on the background of the modernization of the Mongolian legal system, this paper puts forward the hindrance of the Japanese colonial rule toward the latter.3. Exploitation of new materials. In this paper, a multitude of first-hand materials is referred to, much of which is never touched upon in previous studies. And these new materials, I hope, may be beneficial for future studies in this field.
