Social Security Legal System

To adapt to the times need in the construction of Chinese characteristic social security system and provide some theory and policy reference for the construction of the law system, regarding the law system as the main line in research, this text inquiries into the motivation of the system and its theories foundation from the economic, social and political background, studies the process of the system evolution following the angle of the history development, uses the experience for reference and draws lessons from the reform and development of the related system abroad on the international and comparative level, analyzes and studies China's social security law system systematically, where there is already investigation foundation in domestic, analyzes the problems and defects that the current system exists, puts forward some ideas and suggestions of perfecting China's social security law system( particularly the old-age, the medical, the unemployment insurance law system and the law system in rural area) under the situation's development and our country's reality.The full text is divided totally into five chapters. Chapter One is the basic connotation of social security law system. Expounding social security and its law system with the meaning, basic characteristic and contents; analyzing the theories origin and the motivation of the social security law system; clarifying the meaning of reference and enlightening to the construction of our country's social security law system in tracing back to the history evolving process of the law system of nations in the world with generalizing their main types and characteristics; looking back the development and gradual change course of China's social security law system, announcing and pointing out the problems in China's social security lawmaking and countermeasure should be adopted.Chapter Two is China's old-age insurance law system. Summarizing characteristics and categories of the old-age insurance as well as the basic content of the old-age insurance law system; remarking on the typical models and their main merits or shortcomings of the old-age insurance law system of each country in the world; discussing the establishment and development course of our country's old-age insurance law system; pointing out the problems that we should pay careful attention to in the accelerating process of our country's population aging, analyzing the pressure and the challenge it will bring to our old-age insurance law system, and then putting forward some ideas of perfecting the system.Chapter Three is China's medical insurance law system. Delimitating the conception of health, disease risk and medical insurance etc., inducing the basic characteristic and the main function of the medical insurance; Recalling the history proceeding in the medical insurance law system in the world and establishment, development and reformation of our country's medical insurance law system; analyzing the shortcomings of our traditional medical insurance law system and comparing it with the current law system from the aspects such as insurance efficiency, relation of right and duty, security level, covering scope and management methods etc., pointing objectively out the improvement of the current system and the problems to be further resolved; inquiring into the important meaning of establishing our medical insurance law system well at present stage and the related policies & suggestions on perfecting the lawmaking.Chapter Four is China's unemployment insurance law system. Analyzing the main reason that our country brings about the unemployment problems and the social endanger they canproduce following clarifying the concept of unemployment and the awfully rigorous unemployment situation; discussing the important function that the unemployment insurance law system can play in our country's economic system reform, especially in the labor system reform through looking back the system's history progress; investigating the necessity and the urgency of perfecting our country's current u...
