Tourism is one of the most rapid emerging and growing industries in the world. At the same time, China is one of the ten major international tourist destinations in the world, rich both in natural and cultural heritages. Therefore, in the year 2001, Chinese government set the goal of making China a tourism-developed country, resulting in the sweeping combination of fund and resources and the separation of property of tourist resources with its power of management. Up to now, more than 20 provinces and autonomous districts have remited the power of management of their tourist resources or at least on the way and over 300 places of interests are enlisted. There is even no franchise fee in particular cases in some provinces.Encouraged by the government and welcomed by private entities, the franchise practice has caused a grave dispute among experts and higher officials as to the side effect of unsustainable use of tourist resources at the price of natural conservancy and protection. How to see, evaluate and manage tourist resources in a manner of optimized distribution and proper protection has been a brand-new mission for economists and tourist businesspeople. A new task encountering theory in economic field and tourist practice thus emerged concerning the correct cognition, proper evaluation and supervising, optimizing and scientific protection of power of management.Systematic research into tourist resources franchise has just started which is based on the state ownership of natural and cultural relic's resources, aiming at their positive use, conservancy and protection of them in touring industry. No researchhas been conducted by now into the concept, differentiation, traits, ingredients, value and evaluation of tourist resources and their franchise, as well as the institutional pattern for dealing, managing and protecting them. Research conducted into all these above-mentioned aspects, therefore, will get business franchise of tourist resources closer to market mechanism, and consequentially make best use of the franchise with the joint effort of market allocation and government supervision in tandem.This dissertation is a cross-discipline analysis and exploration of the above questions emerged in the practice of tourist industry, the cut-in point being the franchise and the principles set in law, economics and management. In this dissertation, the author first gives a comprehensive account of the current situation of franchise business of tourist resources, theories and opinions from experts and governments in China. Then it approaches to the concept of resources, tourism and tourist resources and the relationship between tourist resources and natural and cultural relic's resources. On the basis of legal analysis of property right and its framework, proprietorship and functions of proprietorship, the author boldly puts forward the concept of franchise dysfunction the separation of authorized business of tourist resources from its property right, and set the framework for the franchise business of tourist resources. To have a better understanding of the component of price and evaluation of tourist resources, the author observed the practice of capitalized management of tourist resources home and abroad, and analyzed the price and profit of tourist resources applying the general economic theory concerning resources. Lastly, according to the principles of management of state capital and particularity of tourist resources, the author clarifies the content of capital management within the marketing allocation frame and the restriction and protection of franchise authorization of tourist resources. As a result, a systematic theory about franchise business of tourist resources is elicited from the framework, and solutions to the practical economic problems in touring industry are given.
