A Legal Study On Development Of Tourist Spots By Private Capital

In China, the tourism industry is one of the earliest industry open to the outside world. Similarly, private capital emerged in China also as a product with the deepening of the reform and opening to outside world. The development of tourism provided a fighting chance for the private sector and in return, the entry of private capital into the industry also injected life to tourism.Private enterprises have not been in the tourism industry long and the size of this capital part is not as big, but, as a newly emerged model, The function department of the government,the enterprises and the academe debate about remise of the tourism spots' management, it reflects the society's attention to the entry of private capital into the industry. So, it is really necessary to study the reason,the movement of the law and the foundation of entry of private capital into the industry,and it is necessary to discuss the basic attribute the tourism recourses,the necessary of the entry of private capital into the industry's development,management and feasibility in theory.This paper tries to probe into the following aspects:1. Since ownership is the primary problem for private capital to enter the tourist industry, this paper analyzes the nature of state-owned equity and verifies the feasibility to split the industry by the nature of different ownerships and sell the operation rights of the industry.2. BOT model is often adopted by developing countries for the construction of their infrastructures. The author holds that with the private sector becoming stronger, BOT model has to be adopted as the best way for domestic companies to be involved in the construction of infrastructures to lessen the tight capital resources of the state.3. Natural resources are the common wealth of mankind. So with the progress of our market economy, So this paper holds that the public should also be placed under the supervision system of the state and their important role in the protection of natural resources and ecological environment should be paid more attention to.
