Sino-U.S, relations, one of the world's most important bilateral relations, have been developing rapidly even though along the zigzags since the establishment of diplomatic relations. As the biggest developed country and the biggest developing country of the world, the U.S. has become China's second largest trading partner and China has become the third largest trading partner as well as the fastest growing export market for the U.S. Such increasingly close ties have brought enormous and tangible benefits to both Chinese people and American people.Along with the Chinese and American economic and trade development, the issue of intellectual property rights which plays an important role at the stage of the modern international politics and economy has become the most important one on the agendas of the Sino-U.S, bilateral relations. The U.S. government and Congress pay more and more attentions on this issue.Enjoying the rights of a wide range of legislative decision-making, the U.S. Congress plays an important part in international affairs and diplomacy, particularly in the U.S. Chinese policy. The Congress decision-making is a complex process in which there are many elements acting each other such as congressman, party struggle, election, interest groups, public opinions, etc. From the historical perspective, the essay follows the trail of the U.S. Congress which is focused on the bilateral economic and trade issues which include MFN, WTO, PNTR and IPR. A clear picture, the U.S. congress plays an important role in the process of the bilateral IPR disputes, has come to the surface.There is no-symmetrical characteristic relating to the Legal System and social culture as well as national strategy on the intellectual property rights between the two nations. On one hand, the U.S. IPR mechanism plays an important role on the international IPR arrangements, and on the another hand, China needs to adjust and improve its systems, step up the protection of IPR, strengthen enforcement against various infringements in accordance with the law. China should protect the legitimate rights and interests of the IPR holders all over the world, including those in the U.S. It is necessary to be ready to settle the IPR disputes with the U.S. appropriately through dialogues and consultations. Based on the research of the Congress decision-making mechanisms, this essay puts forward some constructive policy suggestions so as to facilitate the sound development of the bilateral trade and economic cooperation and to enlarge the space of Sino-U.S, relations.
