Research On Establishing Security System Of Women's Rights And Interests Viewed From Scientific Outlook On Development

The marxism uncovered the laws governing the development of human society. It advanced that the objective of communism is to realize free and all-round development of human being. Women's free development is the important component of human's free development. In order to promote the women's liberation and all-around development, this dissertation has studied the creation of a security system of women's rights and interests systematically and deeply under the guideline of people-oriented in scientific outlook on development. The dissertation firstly briefly described the research meanings, the current research status, the research idea and the research method. Then, it divided the theoretical foundations for the creation of a security system of women's rights and interests into four parts. Firstly, the dissertation discussed Marx and Engels's ideas of protecting women's rights and interests. Secondly, it analyzed Lenin's theory on the protection of women's rights and interests. Thirdly, it described Mao Zedong's contributions to the protection of women's rights and interests. Finally it concluded Deng Xiaoping and Jiang Zemin's new achievements on the theory of the protection of women's rights and interests.On the basis of above researches, the dissertation studied the new requirements of the scientific outlook on development on the protection of women's rights and interests, mainly includes the new requirements on both theory and practice. The new theoretic requirements included that it should insist on humanism, insist on people-oriented as the core philosophy in the creation of a security system of women's rights and interests; it should insist on comprehension, insist on the internal unity between overall development of society and women; it should insist on equity, insist on sexual equity as the ultimate goal of the protection of women's rights and interests. The new practice requirements included that to the methods of protection, implying the basic law and other regulations to protect women's rights and interests; to the subjects of protection, protecting women's rights and interests through multiple subjects, such as government and society communities; to the content of protection, employing abundant content to protect women's rights and interests.Consequently, this dissertation introspected the security system of women's rights and interests in our country on the protection of women's rights and interests from three layers, namely the system of laws and regulations, system of institutions and working system, as well as the six aspects of the protection of women's rights and interests. Although the security system of women's rights and interests was beginning to take shape, many problems are still existing. Firstly, the system of laws and regulations is incomplete. Secondly, the system of institutions is not perfect. Thirdly, the working system is inadequate. Lastly, the specific content of the protection of women's rights and interests need to be enriched. The reasons of the problems are as follows:the traditional sexual culture influenced the health development of the protection of the security of women's rights and interests; the recessive lacuna of legal value in the thought of the protection of women's rights and interests; the impact of economic and market globalization; the lack of publicity and enforcement on national policy of equality of men and women. Under the guidance of scientific outlook on development, according to the practical condition of current development of socialism and combining with the current status of the protection of women's rights and interests, the creation of the security of women's rights and interests was discussed in several methods:Firstly, regarding the construction of the laws and regulations system of the women's rights and interests'protection, choosing scientific legislation pattern and legislating anti-discrimination law, the Domestic Violence Prevention Law, Sexual Harassment Prevention Law; Secondly, concerning the establishment of the constitution system of women's rights and interests'ensurance, enhancing the government's fuctions, transforming the operation model of the Women's Federation, strengthening fuctions of the civil women's organizations, estabishing the Department Linkage System; Thirdly, in the foundation of the working system for guaranteeing the women's rights and interests, improving the socialization of the network the women's rights and interests'security, reinforcing the construction of the contingent, carring out the supervision of the security of the women's rights and interests; Lastly, to further expand the specific content in the region of protection of the women's rights and interests with political rights, cultural and educational rights, personal rights, property rights, women's labor and social security rights, women's rights and interests of marriage.
