University is a kind of loose social organization, in which teachers'research domains are far different from each other as well as their ideals and values. To some extent, teachers'activities and the relationships among teachers and others are standardized and sustained by the teacher management institutions. Whether teachers are willing to abide by the institutions or not lies on the rationality of institutions. A rational university teacher management institution is supported by certain ethical spirits and value ideas. The dissertation aims at studying the substantiation of ethical spirits and value ideas--- institutional ethic of university teacher management.Studying institutional ethic of university teacher management, we should answer the four indispensable questions:ⅰWhat are the ethical details or ethical basis of designing, arranging and renovating university teacher management institutions?ⅱWhether the been or being adopted institutions of teacher management contained such an ethical details since the foundation of PRC? If not, what are the problems and consequences appeared in the reality of teacher management?ⅲWhat are the principles needed to construct such a kind of teacher management institution containing the required ethical spirits and moral requests as we are expecting?ⅳHow to substantiate or institutionalize the ethical spirits and moral requests? The dissertation has analyzed and studied the above four issues with ethical thinking methods of deontology, utility theory, contract theory and rationalism as well as institution analytic method, emic field study, documentation method and interview method.The dissertation brought forward issues from two cases, which reflect the two aspects of rationality of university teacher management institution: government—teacher and university—teacher. It elaborated the background and actuality of the study and defines some related conceptions; whereafter, the significance and value of the study as well as the problems to resolve and the study route have been illustrated. By dint of conception defining theory of logic, the dissertation analyzed and defined institution from four aspects: the category, differentia of institution's connotation, institution's extension and origin, which based on classifying, analyzing and appraising the existed definitions of institution. According to that, the author indicated that by right of regulating teacher's duties, rights and benefits, university teacher management institution standardizes teachers'behaviors and adjusts the regulation system of teachers'relationship. University teacher management institution is an arrangement of institution with reification and it includes multiple levels and types. Macroscopically, the nation's different policies, byelaws and regulations on teachers'status, rights and benefits formed a series of macroscopical institutions of teacher management; microcosmically, university teacher management institution refers to a set of behavioral rule created by the interior practical need of a university. Sequently, on the basis of study and definition about the conception of institutional ethic, the author deemed that institutional ethic study was the study of legitimacy of institution in view of the study content.Centering on the legitimacy of university teacher management institution, the dissertation has studied the logic basis of institutional ethic of university teacher management. Firstly, the dissertation started with the origin and definition of rationality and indicated that university teacher management institution was a logic rule system of substantive rationality and formal rationality. To analyze the rationality of this kind of management institution, it can be conducted in four aspects: substantive rationality, formal rationality, the agreement between substantive rationality and formal rationality, appraising justice and rationality of university teacher management institution. The dissertation has analyzed university teachers'characteristics of work and mentality as well as the characteristics of management institution. It also has studied the function of university teacher management institution, the relationship between institutional ethic of teacher management and individual moral, the eternal value appeal of teacher management institution and factors influencing the design of teacher management institution and some other issues.The dissertation has made retrospect to the historical vicissitude of the modern university teacher management institution in China in both macroscopic and microcosmic aspects. Then it abstracted and summarized the fruitions and defects of construction of domestic modern university teacher management institutional ethic; besides, it has tried to probe into the deep-seated issue ---- what are the ethical thinking methods that have sustained the teacher management institution of domestic university in different stages. The author thought the ethical thinking methods of deontology, utility theory, contract theory and rationalism had exerted great influence on drawing and actualizing teacher management institution in different stages. In the aspects of duties, rights and benefits, the dissertation has analyzed and criticized the defects of domestic modern university teacher management institution, which is on the basis of the above four ethical thinking methods.The author considered that the ethical principles of justice, humanism, democracy and efficiency should be the basal principles of constructing university teacher management institution. Surveying and constructing the relationship among duties, rights and benefits with those ethical principles, the ethic or rationalization of university teacher management institution can be realized.It is proposed that rights, duties and benefits are the core factors for composing university teacher management institution. Under the guide of ethical principle of justice, humanism, democracy and efficiency, consolidating teachers'rights, duties and benefits harmoniously, the institutional ethic of university teacher management can be implemented.
