All these have become the bottleneck and obstacle in economic development of China. Now irregular conducts of local governments result in the confusion of market order. So positioning the role of local governments, transforming the function of local governments, making and implementing the rules of regulating the market order, selecting a good mode of "government-control", preventing the disorder of market economy, raising the competence of market competition, have already become an important and urgent task of constructing Chinese socialist market economy system.It is clear that the market order is both a theoretical and practical subject which has long been neglected and has later on been gradually stressed, developed and created. It is also a grand forward-position problem in the theoretical research of market economy. Regarding local governments' conduct as the basis of constructing the market order, absorbing and learning research achievement of Neo-institution School, drawing lessons as much as possible from some extremely valuable theory achievement of management science, law science, controlling science, etc., such as encouragement and enforcement, innovation-spread-way, legislative mode, the system equilibrium, etc., this thesis carries on a comprehensive study of the relation between local governments' conduct and the construction of market order.This thesis is composed of three parts: a general analysis of local governments' conduct, theoretical analysis of market order, local governments' conduct and the construction of market order.Part one of this thesis deals with general analysis of local governments' conduct. Local governments play a positive role in pushing the economy into market as a main pusher at the beginning of economic pattern reform. With the deepening of economic pattern reform, China's economy develops to enter a key stage and comes across more complicated problems. Finally, in this part the thesis also explains the experiences and lessons upon the transplanting growth of market order, reveals the evolving and developing characteristics and tendency of market order in China.Part three of this thesis gives a concrete observation to the local governments' conduct and to the construction of market order. People desire eagerly to see a healthy and orderly market which with the constant improvement of socialist market economy. The thesis insists that there would not be orderly market without a sagacious government because the government serves as a defender of market order. Due to the traditional planning values, accomplished interests and other reasons, the former administrative power makes China's market order change badly, for the healthy andfair market system remains lack, thus harming the natural function of resource distribution and weakening the environment of fair competition under the traditional circumstances. Under the former economic pattern, the rare resources are not distributed according to the principles of eflBciency, openness, fairness and justice, but distributed according to the "net of power" which can easily monopolize the whole market and defeat any market competitor. The misuse of public power results in the biggest unfairness and becomes the maker of market confusion.
