| The competition in the 21st century is no longer competition between individual enterprises, but is the competition between supply chains. The competitivity of supply chains lie in the market capabilities of the supply chain as a whole. Similar with in the core competence of enterprises, strengthening management towards intellectual property rights such as patent, trademark, and business know-how is also very important for core competence building in supply chains. The key point of intellectual property rights management of supply chain lies in the collaborative management of different enterprises' intellectual property rights. Therefore, unlike traditional perspective from macroscopic (national or local government), mesoeconomic (regional or industrial angle), or individual enterprise, this thesis studies the intellectual property rights from the view of supply chain, and pay emphasis on the collaborative management of enterprises' intellectual property rights in the supply chain. The research provides theoretical foundation and practical instruction for strengthening the core competitiveness of supply chains. The thesis divides into seven chapters, and the content of each chapter is shown as follows.The first chapter is introduction, which states the theoretical rationale. The author analyzes from three aspects, and they are respectively supply chain management, intellectual property rights, and synergetic theory.The second chapter discusses the conflict in the intellectual property rights of supply chain. Twelve kinds of concrete manifestations and five kinds of sources of the conflict are analyzed, and a model is established to express the formation mechanism of the conflict.The third chapter analyzes the basic rationales of collaborative management of supply chain enterprises' intellectual property rights. Its concept is defined, and its primary content is discussed. The author brings forward three basic principles. They are respectively related with all-win, harmony and risk. Comprehensive conflict management theory is elaborated, and specific countermeasures are explored.The fourth chapter discusses the coordinated management of supply chain enterprises' patents. The author proposes three patent development modes, namely, independent mode, chaining mode, and cooperative mode. A three-dimensional development platform is constructed. The contract design of the patent collaborative development is probed into. And then, the author seven primary ways of patents' coordinated utilization, analyzes its trust barrier, contract barrier, and mechanism barrier, discusses its contract mechanism, loyalty mechanism, stimulation and penalty mechanism, supervising and evaluating mechanism. Finally, the main content, instruments and operational mechanism of patent collaborative protection is studied.The fifth chapter probes into the collaborative management of supply chain enterprises' business secret. The author expatiates its legitimate acquisition method and forming mechanism, studies the mechanism design of its protection, discusses the fundamental modes for business secret transfer and the basic principles and concrete operation its collaborative management.The sixth chapter studies the collaborative management of supply chain enterprises' trademark. The author proposes and defines the concept of trademark chain and trademark chain management, summarizes the basic task of trademark chain management, proposes and comparatively analyzes individual trademark development mode, integrated trademark development mode, and dynamic combinated trademark development mode. Finally, the author proposes a strategy for famous supply chain trademark construction based on IPCM (intellectual property rights collaborative management), and discusses the sharing and collaborative protection of supply chain trademark.The seventh chapter is empirical research. Taking Jiayun Automobile Co.Ltd and its supply chain as an example, the author carries out empirical analysis towards the SISA operational mechanism of collaborative management, the platform and process of the patent collaborative development, and the collaborative management of trademark. |
