Research On The Legal Issues Of Cross-border Economic Cooperation Of China-Kazakhstan Huoerguos International Border Cooperation Center

Cross-border economic cooperation zone is a new development under the new situation of economic globalization and regional economic cooperation, the new generation of things, it will certainly bring a new set of legal issues, we need to in-depth study and give a scientific answer. Huoerguos Center is located in the center of central Asia, is the first cross-border economic cooperation zones between Asia and Europe, and is so far the only one cross-border economic cooperation zones of China which the two countries central government formally signed bilateral agreements to establish and jointly invest in the construction. Huoerguos Center currently has entered the construction and started trial operation stage, cross border economic cooperation is also facing a number of new legal issues, if not timely and effectively resolve relevant legal barriers, even Huoerguos Center formally established, it is difficult to effectively carry out operational activities in order to achieve the goal of facilitating trade and investment. This thesis is based on cross-border legal practice of Huoerguos Center, with "joint development" and "win-win" for the idea, based on the present stage Huoerguos Center should be how to create a legal environment for trade and investment in order,to explore and study the legal aspects of the problem of cross-border economic cooperation of Huoerguos Center, with a view to building the rule of law to provide cross-border economic cooperation zones on the system and a mechanism for collaborative development of design ideas.Specifically, in this paper after analyzing the relationship between cross-border economic cooperation zone and economic globalization,regional economic integration and sub-regional economic cooperation, clarifies Huoerguos Center of the legal definition,legal characteristics and legal nature,sorting out of the relating legal norms, aiming at the existing legislation problems of cross-border economic to analysis the necessity and feasibility of collaborative legislation, put forwards the counter measures and suggestions of legislation coordination of Huoerguos Center;For the existing legal problems in law enforcement of cross-border economic cooperation of Huoerguos Center, learning from the successful experience of the EU border region, the US-Mexican border region and the Greater Mekong sub-region Economic Cooperation, put forward specific measures for promoting the law implementation of Huoerguos Center; In addition, combine with geopolitical advantageous of cross-border economic cooperation zone,proposed Huoerguos Center should play a positive role in the construction of China-Kazakhstan as well as bilateral trade dispute settlement mechanism and to resolve trade disputes in the border areas, based on political methods which "framework agreement" has been established, refer to the European Union, ASEAN, NAFTA and WTO international dispute settlement mechanism, proposed to build dispute settlement mechanism of combining political methods and arbitration ways; from the angle of litigation, mediation, arbitration and legal services, thinking of the pathway to resolve border trade disputes approach and put forward to appropriate legal suggestion.
