Research On The Legal Issues Of China-Kazakhstan Huoerguosi International Border Cooperation Center

In 2013, China put forward the idea of the Silk Road Economic Belt, which attracted international attention and positive response, and, at the same time, countries in the Silk Road are gradually reaching a consensus and taking practical action. China-Kazakhstan Huoerguosi International Border Cooperation Center, emerging in the trend of economic globalization, is a key project of Silk Road Economic Belt and is also a new attempt of economic and trade cooperation between China and Kazakhstan and other Central Asian countries. However, as a new thing, the cooperation center still has a lot of legal issues, which attracted broad attentions in the law circle.Firstly, this paper reviewed legislative evolution and basic principles of the cooperation center. Secondly, this paper analyzed a series of legal issues emerging in the build-up and operation process of the cooperation center, such as unclear legal orientation, frustrated trade and investment and unreasonable settlement of dispute. Thirdly, in response to the legal issues of cooperation center, we should draw lessons from the legal mode of regional economic cooperation organizations, such as the EU and the North American Free Trade area. The cooperation center can not completely copy the experience of foreign countries and it should combine with its real situation to explore the appropriate legal mode. Finally, this paper put forward the legal countermeasures and enlightenments:deepen the legislative orientation, promote trade and investment facilitation and improve the dispute settlement so as to take the opportunity of the study on legal issues of cooperation center to deepen the study on legal issues of economic and trade cooperation between Central Asian and China and provide some references to the research on the legal system of regional economic cooperation.
