The Research On Legal Issues Of Huoerguosi International Border Cooperation Center

In 2013,Xi Jinping first proposed to build "The Belt and Road Initiative "strategy,"The Belt "refers to the"Silk Road Economic Belt",and "The Road" refers to"Twenty-first Century Maritime Silk Road". "The Belt and Road Initiative"takes realizing the regional development into consideration, and its implementation should be carried out by way of cooperation with neighboring countries. As China's important development strategy,"The Belt and Road Initiative" is conducive to promoting China's economic opening to the outside world, to a higher level and broader areas of development.At the same time, it conforms to China's economic deeply into the trend of the world economy initiative. In October 2015, China held in the fifth Plenary Session of the 18th CPC Central Committee, it put forward the new development of the concept of innovation, harmony, green, open, sharing,and the concept of open development made a clear requirement for the development of the win-win strategy of opening-up and higher level economy. Therefore, how to deepen the regional economic development has become an important issue facing China in the strategic concept of "The Belt and Road".When cooperating with neighboring countries,we should consider the rationality of location and industry into choice. In the route of "The Belt and Road", Central Asia is an important location which can not be ignored. In order to deepen bilateral border trade development, promote regional integration,the center of Huoerguosi came into being,which is China's first bilateral treaty on the formal establishment of the cross-border economic cooperation zone by the central government of two countries.The Huoerguosi center of China and Kazakhstan has opened up a new channel for the construction of the free trade area in theory. Huoerguosi international border cooperation had been operating since 2012, but there was negative phenomenon,such as motive force lacking of legal construction ,slow development and so on.Therefore,in the background of the new The Belt and Road", taking Huoerguosi international border cooperation as the starting point is very necessary to further study on the legal system in Kazakhstan border trade.This paper takes Huoerguosi center as the starting point, firstly, it defines the center of Huoerguosi, and on the basis,it gives the development characteristics and advantages of the development of history of the center of Huoerguosi an accurate interpretation ;secondly, it makes the narration on the relevant laws and regulations and their application of the Huoerguosi center , and around the applicable jurisdiction,organization mode on the concrete system,it makes a specific elaboration; thirdly,according to the legislation and law enforcement,it discusses the legal issues in the center of Huoerguosi, and the legal issues include bilateral treaties, lack of operability,Kazakhstan coordination of legal system of organization coordination, lack of permanent dispute settlement mechanism vacancy; finally, Under the premise of the top-level design of the legal system in Huoerguosi, combined with the the successful experience of foreign cross-border economic cooperation zone,from the operation,promote bilateral legal enhancement bilateral treaty Coordination, accelerate the exchange of information in the field of Kazakhstan legislation, system of organization adjustment setting and the construction of permanent dispute settlement mechanism five aspects ,it puts forward the corresponding proposal to solve the legal issues of the center of Huoerguosi.
