After The Founding Of The Communist Party Of Chinese Petition Theory And Practice Research

As a special design of the politic system in China, the Petition system is a right relief system to uphold people’s rights and interests and realize their democratic rights. Throughout the development of the Communist Party China(CPC), the people’s Petition system has always been playing an important role in the Party’s development,especially in China’s politic, economic, cultural and social development under the leadership of the CPC. However, with the deepened reform and the rapid development of the socialist market economy, the people’s Petition system experienced a series of problem.Stepping into new phase of the new century, we encountered more social conflicts and more problems in the people’s letters and calls,such as stably high petitioning frequencies, more and more unusual petitioning and collective petitioning, and more frequent collective incidents, which have led to increasingly tense relations between the Party and the masses and between the Party cadres and the masses.Faced with those problems, our party should not only rely on the masses, guide and educate the masses, but also further the blood and flesh relations with the masses, thus laying a solid foundation for the governance. To meet all those requirements, our party should have a reflection and make a conclusion of the existing Petition system and its working practices.Based on this perspective, this paper stars from the induction and analysis of the CPC’s Petition theory and its practices since the founding of the PRC, makes a full use of the existing theory and itspractice fruit, analyses the present stern situation of the Petition system and find the solutions. The paper also presents an outlook of the Petition system from the perspective of the system, mechanism and methodology. The reform of the Petition system is not a simple matter of improvement or abolishment. Instead, we shall increasingly innovate the Petition system and its implementation methods. We should promote the legislation of the Petition system so that we can embrace lawful petitioning and rule of law, featured by lawful petitioning, and responding to and dealing with the petitioning according to the law.The 7 parts of the paper are as follows:Part one: Introduction to the significance of the study and literature review.Part two: illustration of the petition system. It studies the origin of the system, defines and compares the concepts and summarizes its four main functions.Part Three: the introduction to the evolution of its theory and practice. The paper points out that the theory originates from the main ideas of Maximum, namely, internal conflicts, conflicts of interests and hostile conflicts. It explores and summarizes the CPC’s Petition ideas in different periods of Mao Zedong, Deng Xiaoping, Jiang Zemin and Hu Jintao.Part Four: analysis of the development of petition practice petition since the founding of the PRC. It sorts out the mechanism and development of the petition system and concludes that it has contributed greatly to the consolidation of the governing of the CPC.Part Five: experience and lessons learnt. Experience include : 1.The petition system should firmly adhere to the leadership of the CPC;2. It must, keep pace with the times; and 3. It must be dealt with in accordance with the law. Lessons include: 1. the conflicts between limited functions of the system and unlimited expectations for the system; 2. the conflicts between, the Petition system and the judicial system; and 3. the conflicts between the petitioner and the petition handler.Part Six the study of the current situation. It analyzes the causes of the serious situation and suggests measures to address it.Part Seven: conclusion. It analyzes the four different ideas towards the Petition system within the party and academy, discusses the vision of the system: integrating its resources, adjusting its functions, regulating its orders and toughening its procedures. Through improvement of the system and innovation of the practice, we shall guide people to petition more by letters than visits, discourage them from petitioning beyond the immediate jurisdiction level, and encourage them to safeguard their rights in accordance with the law so as to push forward the legislation of the Petition system and rule of law.
