Awakening awareness of the rights of athletes reflected the profound changes brought by market-oriented reform in the field of Chinese competitive sports.Protection of the rights of the athlete,embedded in the background composed with the whole country’s economic transition, institutional changes and social transformation.The sports management systems in different era,sculptured different characteristics on the individual rights of the athlete:in the planned economy system,the supremacy of collectivism and prevalence of collective rights-personal obligations,lead to neglecting the personal interests in name of carrying out the whole interests in the long run.Market-oriented reforms in theory restored the status of personal individuality and self-government,which set free the individual interest from the moral negative values.More importantly,the spurt of market development definitely established the moral legitimacy of individual interests.As a result,the athlete rights increased obviously in quantity,their economic rights in particular.At the same time,with diversified interests of competitive sports has a shown initial sign of internal clues, athletes recovered the sense of individual rights,so the need for the protection of the rights of athletes appeared to be desperately urgent and important in terms of balance the personal interests and the public. The market-oriented reforms in the competitive sport achieved,but the core task does not occur to a fundamental shift from the political mobilization to the economic growth.With the single target to serving the state ideology,the monopoly of executive power remains unchanged, if not strengthened after entering the market and gaining more power. The collective moral and ethical and ideological education of the athletes still hold up the dominating position,only the rights of the individual athletes marginalized dormant.As the gold-medal-chaser, athletes,subject to strict physical and mental control,held the unfair position without any room for bargaining,which decided their role continued to be the passive recipients.Meanwhile,market-oriented reform of the system improved the realization of the personal rights; athletes had to live with greater challenges or higher risks accompanying with the social transformation.Athletes therefore still remained dependent to the system,in other words,they have to compromise with the authority based on rational consideration.Without the built-up of the rule by law,protection of the athlete rights would be more than political declaration since it could not exist without relevant institution supply and all kinds of resource controlled by the government. The issue about the athlete rights protection,not only reflects the conflict between the personal interests and public interest,between individual rights and public rights,in fact,it also demonstrated the accomplishment of the rule of law centered on the people-oriented principal,as well as the conflict between national preference and social need.Under the premise of sticking to the market-oriented reform within the system of centralization in sport,how to restrain the executive powers,monitor the operation of the power on purpose of preventing power abuse,in a sense,will provide new opportunities to improve the athlete rights protection.
