The socialist rule of law is an objective requirement for achieving social stability and national long-term stability. Enrollment by law is the inevitable requirement of building the ruled-by-law society in China, and is also the inevitable requirement of managing education by law and ensuring fair and impartial education. The university and college enrollment carries the candidates' dream of entering the universities, the parents'and society's hope for the future and the people's pursuit for the fairness and justness of the enrollment. How to promote the process of rule of law in enrollment, construct a university enrollment system based on fair rules, open processes and just results, and safeguard the legitimate rights and interests of the candidates is the urgent requirements for the reform of the examination and enrollment system, and is also the powerful guarantee to realize the strategy of reinvigorating China through human resource development.The paper studies the rule of law in college enrollment in China from five aspects. The first aspect is introduction. The paper studies the background of the rule of law in college enrollment, including strategic background, legal background, reform background, policy background, practical background and the prevention and control background. At the same time, the significance of the rule of law in college enrollment is also studied. The paper makes a summary of domestic research on seven aspects, such as the content, principle and significance of the rule of law in college enrollment, the management and distribution of enrollment plan in colleges and universities, and so on; the paper takes a review of the research on the enrollment system and the rule of law in foreign countries from the following aspects:college entrance examination system, entrance examination subjects and contents, form of entrance examination and admission standards, etc. The second aspect is the theoretical basis and historical evolution of the rule of law in college enrollment in China. The paper discusses the concept of the rule of law in college enrollment in China, analyzes the theoretical basis, such as Marx's theory of rule of law, equality theory, right theory and the theory of governing the country by law, reviews and analyzes the historical evolution of the college enrollment system and the rule of law in our country. The third aspect is the present situation of the rule of law in college enrollment in China. The paper analyzes the achievements, problems and causes of the rule of law in the college enrollment in China from the aspects of the idea of rule of law, the culture of rule of law and the implementation process of the rule of law. The fourth aspect is the characteristics and enlightenment of college enrollment system and the rule of law in foreign countries. This paper analyzes the characteristics of college enrollment system and the rule of law in the United States, Britain, Japan, Russia, and compares that with China; makes a reflection on and puts forward to the enlightenment of the rule of law in college enrollment to China. The fifth aspect is the idea of improving the rule of law in the college enrollment in China. The paper puts forward to establish the concept of the rule of law college enrollment, cultivate the culture of the rule of law in college enrollment, straighten out and clarify the legal relationship of college enrollment, improve the path of the rule of law in college enrollment. The paper puts forward six countermeasures to improve the path:the rule of law in college enrollment plan, the rule of law in examination subject and content setting, the rule of law in the examination method, the rule of law in the way of admission, the rule of law in the management process system and the rule of law in right relief.
