| The legal system of Nanjing city is for city management after Nanjing was founded as the capital of Republic of China.Different from the legislative thoughts of modern Shanghai which are from the western legal thoughts of the concession,Nanjing city's legal system was the results referring to the legal culture of both Chinese and the western.In addition,it is necessary to investigate the application of the law in urban management,while investigating the system,and removing the static rules and regulations.Based on that,this dissertation will discuss in five aspects.Firstly,the first chapter is the summary of modern western urban planning and management legal system's transplantation and introduction,which is mainly divided into two aspects: one is the western countries seized concession after China opened its door.In order to keep the concession stable and orderly,city planning thoughts,system and regulations were gradually introduced into China by the authorities.That played a strong role in promoting legal system planning and management.The other one is that the introduction of advanced western concepts and legal system of city planning and management greatly stimulated the prosperity and stability of China cities' manager.From the development of sporadic concession in the late Qing Dynasty,to the cities' autonomy,including Beijing,Shanghai,Guangzhou,Tianjin and other big cities.Finally,the Republic of China,from the central to the local cities,fully carried out western legal system,which shows that the western city planning and management system has been fully accepted in China cities.Secondly,the first chapter is going to do introduction of Nanjing City at that time.Although compared to Beijing,Shanghai,Nanjing is a medium-sized city.But it is also an open city.Inmodern times,Nanjing further developed its economy as the base of unique position as capital of the country.The development of economy has brought many municipal social problems to urban development.Therefore,as the capital city,it is necessary for Nanjing to manage its legal system.The second chapter will describe the beginning of Nanjing city's planning and management system.First of all,the analysis in this dissertation refers to how communities think about it,Sun Zhongshan and Sun Wen's ideas of legal planning,what contribution western scholars have done to modern city planning and legal culture,new municipal city legal scholars' cultural thoughts.Through the analysis of the legal thoughts of planning above,the research is aims to analyze its influence on the capital Nanjing's thoughts of legal planning.Secondly,based on the analysis of the background,game of political rights in the formulation process,main content,competition between parties in the implementation process,and typical regulations of“Capital Plan” passed by central government of Nanjing,this dissertation will elaborate “capital plan” as a application of planning law in practice,which construct the capital of the Republic of China for 10 years,and then will explore its influence on Chinese modern city planning legal culture.The third chapter focuses on the analysis of social security management in Nanjing city.In the beginning,this dissertation is going to discuss the change of police system in the game of central and local autonomy based on the establishment of law enforcement agencies in Nanjing city,and refer to the contribution of administrative justice in one system,which is different from traditional Chinese,to modern city management legal system.Then,there will be dynamic analysis of the case of the prostitution and drug prohibition,and public security management system of Nanjing City.Having a comprehensive knowledge of the law of Nanjing public security management laws is both show the style of local autonomy and fully implement to central regulations.There are also setbacks during its execution.Finally,through a case study,this research will analyze results of Nanjing public security management system,and led to that management is not only legal operation,also it need some legal relief.The fourth chapter will take public utility management in management legal system of Nanjing city as an example,regarding the case of residential traffic and public health as clues,to look through how the management legal system in Nanjing city play a role in the public utility management.In this kind of management,relatedinstitutions can improve with the change of social problems.And the formulation of regulations is also in a dynamic process,the system is more and more strong.At the same time,the legal management of removing social ills promoted utilities construction in Nanjing city and have a good effect.The fifth chapter analyzes the legal system of urban management in Nanjing during the period of the Republic of China from the following two aspects:modernization and localization.As to modernization,firstly,there is the description of theoretical history of modern management in Nanjing city;secondly,this dissertation is going to narrative that the leader of the Nanjing city planning led the study and practice of the western cities' planning legal thoughts from the overall;finally,there is comprehensive evaluation of the modernization of the system of Nanjing city's management legal system from the following aspect: the modernization of organization,personnel,and legal system.As to localization,this research does the comparative analysis of concepts “localization” and “local resources”;secondly,there is the analysis of the performance's localization of Nanjing city management legal system from the perspective of party-state system and traditional factors.In addition,on the basis of these two aspects,this dissertation makes a preliminary exploration on the Enlightenment of the urban management in Nanjing.In conclusion,this dissertation will elucidate the establishment of Nanjing's management legal system express the establishment of the modern administrative legal spirit in China.Then,It is very important for Nanjing to re-examine how the Chinese and western legal culture influenced legal system in Nanjing,so as to the modernization of traditional Nanjing. |
