Since the beginning of group activities,meetings and conferences which are consultative ways to settle down human disputes and contradictions peacefully,are age-old and practice in human society.After a long period of neglect-cognition-research,the rules of procedure have been widely used in legislative.social and business meetings.Human group activities no longer lack the justice.democracy?consultation and efficiency due to the difficulty of public opinion or the dominance of only strongest status.Generally speaking,the content of the rules of procedure is composed of the general rules of procedure and the special rules of procedure formed by property and content of the conference.The actual carrier and standard object of the rules of procedure can only be the meeting activities.In order to ensure the normal proceeding of the meeting and draw conclusions within the prescribed time,all aspects of the meeting need to be regulated.The rules of procedure are divided into subject rules of procedure,object rules of procedure and rouinte rules of procedure,the three parts can be regulated separately,but linked closely in practice.Object rules of procedure are the operation precondition,procedure rules of procedure are the operation axis,while subject rules of procedure are the operation guarantee.The forming environment of the rules of procedure of China's National People's Congress has a long tradition of discussing politics,but it is not an environment with real ability of deliberation.The generation and development of Rules of procedure of NPC,all the way began from the First Revolution to pilot exploration,combined with China's actual situation and practice,experienced a period of instability in national conditions,ushered in a published rules of legal procedure finally under the guidance of the communist party of China.Today,the rules of procedure of NPC have been revisied and improved on proposeing?reviewing?inquirying?speaking and voting,on the appointment and election in different degrees,following the requirement of opening and reform as well as free our minds.The rules of procedure of the people's congresses are the behavior steps and rights of participation which are set for the wide realization of the fundamental interests and needs of the people under the conditions of consultation.The structure and function of rules of procedure of NPC display through three aspects specificly:firstly,the rules of the subject of NPC which includes counsellor,registrant,moderator and facilitator,embodies the function in clear and reasonable distribution of the deliberative role;secondly,the rules of the object of NPC which standardizes comprehensive bills,individual bills and Informal bills,plays the role of ensuring the normal conduct of all the parliamentary activities of the NPC;thirdly,the rules of the routine of NPC which guidesd by the principles of democratic centralism,has deliberation?inquiry and questioning-voting three main procedure,between the subject and object of the procedure of NPC to coordinate the discussion.It is not hard to find that there are still many shortcomings in the rules of procedure of the NPC.As one of the subject of the NPC,the function of ordinary representatives is insufficient,and the decision-making ability of local NPC delegations is obviously different;as the object of the people's congress,bills are lagging behind and formalized in their formation,and their major matters are not well regulated;in the proceedings of the NPC,there are still many problems in its regulation,including the system of the session and the setting of the agenda.So,we still need to find that root of all problems in China's own national conditions and reality system,which lies in the coordination of the relationship between party and government,between economic development and system construction,traditional culture influence.As a practical manifestation of the exercise of state power by the people's congresses,the ongoing attention and improvement become into integral part of the development of socialist democracy and the realization of a happy life for the people.We should optimize the rules of procedure of the NPC focused on three components mainly.To set the rules of procedure of the presidium more scientific,coordinate the relations between the presidium and other participants,delineate the ability to review bills and reports scientifically,play their own work on review the original and preside over the meeting of the presidium as far as possible.To set and operate the power of major matters more precise,to make rules on what is important and what is special detailed?deepend and operationalized.To standardize and pay more attention to the debate mechanism of parliamentary procedure,reflecte the core and value of this debate in proceedings of deputies to people's congresses at all levels.By standardizing the presidium,debate mechanism and major issues of the NPC,we hope that the rules of procedure of the NPC at all levels can play a stronger role in realizing justice,democracy and efficiency.
