Since the founding of the People's Republic of China,the legislation of ethnic education has gone through more than 70 years of trials and hardships,with abundant legislative achievements and increasingly perfect legislative system.However,in general,the development of ethnic education in China is still relatively backward,which is mainly manifested in the large gap between ethnic education and the overall education level of the country,and the uneven development of ethnic education in different regions.To deeply understand Xi Jinping's new goals and tasks of ethnic work in the new era,that is,the unity and progress of ethnic groups to create and consolidate the consciousness of the Chinese national community are closely related to the development of ethnic education.In view of the new era ethnic work of new tasks and new requirements,as well as the present situation of the ethnic education lag behind,according to Xi Jinping,the new era of ethnic work of the new path,namely to uphold and improve the system of law about ethnic problem,and promote ethnic affairs management ability and level of the rule by law in order to promote the new development of ethnic education,so as to better for a new era of ethnic education related tasks.The first step to improve the legislation of ethnic education is to adhere to and perfect the ethnic education law and system.Especially under the background of comprehensively governing the country according to law proposed by the CPC Central Committee in the new era,deepening the reform in the field of rule of law,and constantly improving the quality and efficiency of legislation,the improvement of legislation on ethnic education not only conforms to the needs of The Times of strengthening the construction of laws and regulations on ethnic work in the new era and comprehensively building a country,government and society under the rule of law.It is also of great significance to the realization of the vision and goal of building a strong country in education in the new era and the realization of high level and balanced development of ethnic education.Based on the basic requirements of the ethnic work in the new era and the construction of China under the rule of law,this paper examines and reflects on the problems existing in the ethnic education legislation and puts forward countermeasures to improve it.This is not only the demand of doing well the ethnic work in the new era,promoting the rule of law in an all-round way and building a strong country in education.It also reflects that the field of ethnic education in the new era consciously uses the rule of law thinking and way to promote the development of ethnic education and solve the problems faced by ethnic education.Therefore,the topic has the significance of The Times and ethnic strategic significance.According to Xi Jinping's summary of the "new situation","new task" and "new path" of China's ethnic work in the new era,as well as his requirements for the in-depth promotion of "scientific legislation,democratic legislation and law-based legislation" in the new era.On the one hand,it clarifies the characteristics,changes and achievements of China's ethnic education legislation in different periods.That is to say,the ethnic education legislation in China has experienced a change from the non-essential legislation to the initial formation of the legal and normative system of ethnic education,and then to the change of making the legal and normative system of ethnic education more epochal through modification and clearing.The purpose of ethnic education legislation has experienced the change from training minority cadres and improving minority culture to cultivating minority talents.Ethnic education legislation has undergone a transformation from safeguarding minority students' right to receive education to promoting educational fairness.According to the historical experience of China's ethnic education legislation and the requirements of the development of ethnic education in the new era,the value orientation of China's ethnic education legislation is established on the path of perfection of ethnic education legislation from the perspective of new era.On the other hand,it focuses on the analysis of the status quo,problems and causes of China's ethnic education legislation.Are made valid by means of the current our country current ethnic education and regulations as the basic analysis of samples,from a number of ethnic education legislation and legislative mode,legislative level and regional distribution,legislative content and timeliness Outlines the present situation of our ethnic education legislation,and sums up the problems of analysis of the problems and causes of China's ethnic education legislation,it can be found that China's ethnic education legislation does not carry out enough of Xi Jinping's comprehensive rule of law concept and ethnic work requirements in the new era.Therefore,it is necessary to further improve China's ethnic education legislation from the perspective of the new era.Combined with the above analysis of history and reality,on the basis of clarifying the historical achievements,current situation,problems and causes of China's ethnic education legislation,this paper puts forward the realistic path to improve China's ethnic education legislation from the perspective of new era.First of all,some basic principles should be followed to ensure the direction of progress.Based on the new era,the consciousness of the Chinese nation community should be firmly established,the national "five-in-one" strategy,and the comprehensive rule of law strategy.Under the new era perspective,the improvement of ethnic education legislation should first be systematically planned and macroscopically planned.On the construction of macroscopic strategy,it is a very important project to perfect ethnic education legislation from the perspective of new era,which mainly involves four aspects.First,make clear the value orientation of ethnic education legislation,that is,solidify the consciousness of the Chinese nation community;Cultivating innovative minority talents;Promote the healthy and sustainable economic development of ethnic minority areas;We will protect and carry forward the fine cultures of ethnic minorities.Second,to establish the principles of ethnic education legislation,including general principles,special principles,efficiency principles.Third,establish a new era of legislative ideas,scientific use of local legislative power and self-governing legislative power.Fourth,we should constantly improve the legal system of ethnic education.Second,macro,vitality and validity of the principle measures should reflect on falls down small,thin,to the new time horizon,the improvement of the ethnic education legislation will ultimately from the formulation of ethnic science education legislation plan,improve the ethnic education legislation content,norming the program of ethnic education legislation,improve the level of ethnic education legislation technology and strengthening the specific ethnic education legislation assessment efforts.
