It's of great importance strengthening more researches on ethnic minority education's legislation (EMEL). Propelling the theoretical and practical construction of EMEL can not only carry forward the establishment of subjects like educational law, ethnic law and ethnic pedagogy, ensure the reformation and development of ethnic education, maintain ethnic minority students' equal right of education, enhance ethnic minority education's quality, but also can establish and improve China's characteristic educational system, propel Science and Education's Strategy and High-quality Human Resources Strategy of National Development. It's especially important for the course of strengthening national solidification, accelerating Western China Development strategy, propelling ethnic minority area's economical development and social prosperity, establishing "Xiaokang" society, even for the third aims of socialistic modernization strategy and Chinese nation's great reborn in the 21 century it also has deep influence. Faced with the poor current situation of China's ethnic minority education's legislation and lag development, therefore, this article obviously has great theoretical and practical value and farsighted realistic significance.By using theories and methods of different subjects like pedagogy, educational law, ethnic law, ethnic pedagogy, multicultural education, educational anthropology, educational management and so on, the article entirely analyzed historical and current situation of China's EMEL. Through the use of the instructive experience of Taiwan and American's EMEL. it did its research mainly from central and local level, establishing basic theoretical theory of China's EMEL, propelling and strengthening establishment of ethnic minority education's legislation, therefore helping completely alter the poor condition of ethnic minority education, gaining fantastic development and providing strong legal support and guaranty.The whole of the article has eight parts:The first part is the introduction; it clarified the purpose and significance of the article, relevant documents' analysis, basic thinking and method, basic and creative ideas and so on.The second part discussed historical and present conditions of EMEL. In this part, it divided EMEL's development into 5 relatively independent phrases, according to our ethnic minority education and EMEL's developed orbits. It wholly elaborated different phrases' EMEL's situations, achievements, contents and so on; at the same time, it also discussed regional EMEL's developing situations. Based on the above elaborations, the article analyzed problems in the process of China's EMEL.The third discussed basic theoretical problems of China's EMEL. According to the current situations and problems in the EMEL, the article mentioned its concept. foundations, guidelines, principles, contents, procedures, predictions and legislative programs.The fourth is China's regional research on EMEL. China's regional EMEL developed with the national legal system's development and regional legislative power's reconfirmation at the end of 1970s. In this part, the article discussed regional EMEL's concept, foundations, basic principles, characters and the relationship of central and local EMEL and so on.The fifth is the research on Taiwan aboriginal education legislation. As the important part of Chinese multicultural education, Taiwan aboriginal education is the common project of both sides and is also in the need of propelling the theoretical and practical construction of mainland ethnic minority education's legislation. In this part, the article elaborated the Taiwan aboriginal survey; origination, contents, characters, experiences and problems of Taiwan aboriginal education legislation, and also it provided considerations of improving Taiwan aboriginal education legislation.The sixth is international view on EMEL, especially focusing on American EMEL.
