Research On The Influence Of Intellectual Property Protection On The High Quality Development Of China's Foreign Trade

In the process of China's economic reform and opening up,intellectual property protection has promoted China's economic development and technological innovation.In foreign trade,the improvement of intellectual property protection level shows the improvement of the business environment and the construction of legal system.At the same time,it is also reflected at the improvement of foreign trade content,structure and power innovation.The protection of intellectual property rights not only directly promotes the development of trade in services such as intellectual property rights,but also promotes the trade of products,so that the foreign trade can be optimized in scale and the value added products,value chain status.That is why,after the 19 th National Congress of the Communist Party of China made it clear that China's economy will shift from high-speed growth to high-quality development,in November 2019,the Central Committee of the Communist Party of China and the State Council issued the Guiding Opinions on Promoting High-quality Development of Trade,which set out clear requirements for high-quality development of foreign trade: the structure of foreign trade has been further optimized,foreign trade benefits have been significantly improved,and foreign trade strength has been further strengthened.In August 2020,the Ministry of Commerce issued the Opinions on Further Stabilizing Foreign Trade and Foreign Investment,it is clearly pointed out that high-quality development of foreign trade will be promoted through optimizing the international market layout,domestic regional layout,business entities,commodity mix and trade mode,and so on.The Fifth Plenary Session of the 19 th Central Committee further clearly pointed out that we should base on the Great domestic cycle,give full play to our comparative advantages,promote the expansion of the domestic market and the construction of a trade power,and actively promote the coordinated development of domestic demand and external demand,import and export,and the introduction of foreign investment and foreign investment.High-quality foreign trade is very important for promoting high-quality development and building a new pattern of double-cycle development.How can intellectual property protection better promote the high-quality development of foreign trade? It is very important to both theoretical research and practice.On November 30,2020,when presiding over a group study of the Political Bureau of the CPC Central Committee,General Secretary Xi Jinping reiterated that intellectual property protection is related to all aspects of China's high-quality development and the overall situation of the country's opening to the outside world.How does intellectual property protection promote the development of foreign trade?The field of economics has accumulated rich research results,however,there are still many problems to be solved for the high-quality development of foreign trade.First of all,how to understand the connotation and extension of high quality foreign trade,how to define high quality development of foreign trade in multiple dimensions,and quantify these dimensions? Secondly,consider the typical facts and internal mechanism of IPR protection to promote the development of foreign trade since China's reform and opening up,it is necessary to consider how to evaluate and measure the level of intellectual property protection.Finally,how to start with the goal of building a new development pattern,under complex circumstances such as rising protectionism and unilateralism in international trade and the China-US trade war,according to the current situation,through the appropriate system supply,effectively promote the positive effect of intellectual property protection on high quality foreign trade? According to the above logic,constitutes the main body of this dissertation.The logical order of this dissertation is as follows.This paper starts from the perspective of intellectual property protection in China and takes the high-quality development of China's foreign trade as the research objective.First of all,this paper takes basic theories and important exposition related to intellectual property protection and foreign trade in Marxist economics and western economics as the logical starting point.Secondly,on the basis of reviewing the existing domestic and foreign theoretical and empirical literature related to intellectual property protection and foreign trade,the connotation of intellectual property protection and high-quality development of foreign trade is defined to lay a theoretical foundation for subsequent research.Then,the historical development of China's intellectual property protection and foreign trade is sorted out,and the role and typical characteristics of China's intellectual property protection and foreign trade development in different periods are analyzed.Then theoretically analyze the influence mechanism of intellectual property protection on the high quality development of foreign trade,and analyze the influence of intellectual property protection on foreign trade structure,foreign trade benefit and foreign trade competitiveness.The level of national and provincial intellectual property protection is measured by the modified GP index method.On the basis of constructing the evaluation index system of the national and provincial high quality development level of foreign trade,the paper measures the national high quality development level of foreign tradeand analyzes the provincial high quality development level of foreign trade from the perspectives of spatiotemporal evolution,distribution dynamic evolution,spatial differences and sources.Then the comprehensive coordination relationship between national and provincial intellectual property protection and high quality development of foreign trade is investigated,and the comprehensive coordination relationship between intellectual property protection and foreign trade structure,foreign trade benefit and foreign trade competitiveness is analyzed.To further consolidate,revise and refine the aforementioned research,Empirical analysis of the impact of intellectual property protection on high-quality development of foreign trade,and through different threshold variables to investigate the non-linear effect of intellectual property protection on high-quality development of foreign trade,And further empirically investigate the influence of intellectual property protection on foreign trade structure,foreign trade benefits and foreign trade competitiveness.On the basis of the above research combined with the realistic constraints,appropriate policy recommendations are given.The main conclusions of this study are as follows:First,intellectual property protection has different degrees of promoting effects on the high-quality development of foreign trade in the eastern,central and western regions,with the best effect on the high-quality development of foreign trade in the central region and the worst effect on the high-quality development of foreign trade in the western region.Taking the real per capita GDP and the openness of foreign trade as threshold variables,the results show that the impact of intellectual property protection on the high-quality development of foreign trade is significantly positive and the marginal efficiency is increasing.The protection of intellectual property rights is more conducive to the promotion of high quality development level of foreign trade in the stage of high opening degree than in the stage of low opening degree.Taking real per capita GDP as the threshold variable,the higher the level of economic development in the eastern and central regions,the stronger the role of intellectual property protection in promoting the high-quality development of foreign trade.When the openness of foreign trade is taken as the threshold variable,the promoting effect of intellectual property protection on the high-quality development of foreign trade in the three regions increases with the increase of the openness of foreign trade.Second,strengthening the level of intellectual property protection in China has played an effective role in promoting the structure,efficiency and competitiveness of foreign trade,but there are differences in the eastern,central and western regions.From the perspective of foreign trade structure,intellectual property protection has the best promoting effect on the foreign trade structure in the central region and the worst promoting effect on the foreign trade structure in the western region.From the perspective of foreign trade benefits,the promotion effect of foreign trade benefits in the central region is the best,while the promotion effect of foreign trade benefits in the eastern region is weak.From the perspective of foreign trade competitiveness,intellectual property protection plays a stronger role in promoting foreign trade competitiveness in the central and western regions than in the eastern regions.On the whole,the coordination between intellectual property protection and high-quality development of foreign trade,foreign trade structure,foreign trade benefits and foreign trade competitiveness is in a better and better state,but the coordination degree still needs to be improved.Thirdly,the measurement of intellectual property protection level shows that the level of intellectual property protection in China is rising year by year,but the development of intellectual property protection level in provinces is unbalanced.Among them,the average value of intellectual property protection level index in the eastern region is much higher than that in the central and western regions.Except for 2015,2017 and 2018,the average value of intellectual property protection level index in central China was slightly higher than that in western China.The level of intellectual property protection varies among provinces in China.The level of intellectual property protection in core provinces such as Beijing-Tianjin-Hebei Economic Circle,Yangtze River Delta Economic Circle and Pearl River Delta Economic Circle is obviously higher.Fourthly,through the foreign trade structure,foreign trade benefit and foreign trade competitiveness of three dimensions of China's foreign trade quality development level to construct an evaluation index system and measure the results show that,except in 2009,the high quality development level of China's foreign trade shows an increasing trend,but the high quality development of provincial foreign trade is unbalanced.Among them,the eastern region has the highest level of high-quality development of foreign trade,but the gap between the provinces in the eastern region is the largest,but in recent years,the gap is gradually narrowing.The difference of high quality development level of foreign trade among provinces in central China tends to be balanced.The differences in the quality of foreign trade development among the provinces in the western region are increasing year by year.The difference of the high quality development level of foreign trade among the three regions is the main reason for the difference of the high quality development level of foreign trade in China as a whole.The innovation points and contributions of this dissertation are mainly reflected in:First,from the perspective of research,most of the literature studies the impact of intellectual property protection on foreign trade development between developed countries and between developed and developing countries,and mainly focuses on the single dimension of trade structure,scale or benefit,in this paper,based on the definition of high quality of foreign trade in the Guidance Opinions on Promoting High Quality Development of Trade by the CPC Central Committee and the State Council,a systematic foreign trade quality evaluation system is established,and the influence of intellectual property protection on the high quality development of China's foreign trade is emphatively explored.Second,enrich and improve the construction,measurement and analysis of the evaluation index system for the high quality development level of foreign trade at the national and provincial levels.The different influences of intellectual property protection in different regions on the quality of foreign trade in different stages are compared and analyzed by region and time.It is helpful to the precision and difference supply of foreign trade promotion policy and intellectual property protection policy.Thirdly,this paper tries to establish two systematic index systems to evaluate the level of intellectual property protection and the quality of foreign trade development,and makes some innovations in index selection and data processing methods.Fourthly,the conclusion of this paper shows that the promotion effect of intellectual property protection on foreign trade quality is different in different time periods and different regions.When the actual per capita GDP is lower than 9321.45 yuan,although intellectual property protection can promote the development of foreign trade,the effect is not as obvious as when the level of economic development exceeds the threshold value.To some extent,this confirms the theoretical hypothesis of development economics on the catch-up process of backward countries,that is,for developing countries,the incentive effect of intellectual property protection is not obvious if they lack certain technological capabilities.Due to the large data volume and long time span,there are still some areas to be expanded and improved in this study.For example,incomplete year data and inconsistent statistical caliber have affected the development of empirical process.It fails to extend the influence of intellectual property protection on foreign trade quality to specific industries,and only examines the influence of intellectual property protection on the high-quality development of China's foreign trade from a macro perspective,and so on.China and the world are at a historic juncture of profound changes unseen in a century.With the Sino-US trade war and the changing international economic order,new problems and challenges in trade are bound to emerge one after another.How to continue to grasp the key issues in the complex and changing environment,and how to continue to follow up and deepen the research on the high quality development of foreign trade from the perspective of intellectual property protection will be the main research tasks of the author for a long time in the future.
